A list of the models of the physical servers, storage devices, tape
libraries, network switches and routers under support contracts; as
I would also request the name of the person/s in your organisation
responsible for the maintenance support contracts.
well as the cost and duration of said contracts, with start and end
dates and service level associated with the equipment. Could you
also supply the names of the suppliers of aforementioned support
services?

Dear Mr Long,

Thank you for your email of 17 August 2015 asking for information about the Intellectual Property Office’s IT hardware maintenance and costs.

Please see the attached list giving contract names, suppliers, approximate start and end dates and estimated value of each contract.

The precise product details are withheld for IT security reasons. The omitted details are exempt under s.31 (1) (a), which applies to information, the disclosure of which would or would be likely to prejudice the prevention of crime. The exemption is considered to apply because information regarding the exact products could be exploited by persons with malicious intent to compromise data security. That is not to say we consider that you would make use of the information in this way, merely that disclosure of this information could inadvertently result in it falling into the hands of those capable of misusing it.

The exact contract dates are withheld for similar security reasons to that given above in relation to the exact names of hardware. The reason for this is we recognise that systems are particularly vulnerable to attack at or around the times of contract replacement or renewal, a risk that may be mitigated by avoiding the disclosure of exact information regarding the timing of such contacts.

S.31 is a 'qualified' exemption, which means that we are required to consider the balance of public interest for or against disclosure before deciding whether to maintain the exemption. Having considered this matter we have failed to identify any overriding public interest arguments in favour of disclosure.

We are however content to disclose the names of manufacturers and approximate dates to the nearest quarter.

You have asked for the name of the individual officer responsible for these contracts. This information is withheld because it is exempt under s.40 (2) of the FOI Act, which applies to personal information, in this case the personal data of a junior civil servant, whose identity is not in the public domain. Section 40 (2) of the FOI Act provides that personal data is exempt if one of the conditions set out in section 40 (3) is satisfied. Under the FOI Act disclosure of this information would breach the fair processing principle contained in the Data Protection Act where, as on this occasion, it would be unfair to those persons.

I appreciate that our partial refusal may be disappointing to you. If you are dissatisfied with the handling of your request you have the right to ask for an internal review.
