company/organisation name, date and amount over the sum of £500.00
received & paid by Falkirk Council for the financial years
2008/09
& 2009/10. Please confirm the date the invoices were paid.

Please confirm when you will comply with recommendations and
guidance from the Government to publish this information on a
regular basis on the Council website.

I attach a list of invoices in the format requested. Any payments
considered to be of a confidential nature have been excluded.

To date the Scottish Government has not produced any guidance
regarding disclosure of information of this nature.

Some of the payments are excluded under section 38(1)(b) on the
basis that they comprise personal data which, if released, would
breach the terms of the Data Protection Act 1998, (eg payments to
foster parents, payroll adjustments and pension lump sums.) Other
payments are excluded under sections 36(1) and 33(1) on the basis
that they comprise information in respect of which a claim to
confidentiality of communications could be maintained in legal
proceedings, and/or they comprise information which, if released,
would be likely to substantially prejudice the Council’s commercial
interests (eg payments of legal fees to solicitors in respect of
ongoing court actions). In the latter case, it is considered that
the public interest in protecting this information outweighs that
in releasing it.”

complain about the handling of your request and/or the decision
made.

It looks as though you have a very slippery customer here, but not as bad as West Lindsey (Lincs)District Council. Keep at them and don't let them wear you down with delay, evasion ands obfuscation. Good Luck.

I would refer you to the 2nd paragraph of my initial response which
states that Scottish Government has not produced guidance regarding
disclosure of this information.
