How do explain "public interest"? Have you ever asked the publics
interest in "public interest"?

I have received this information from every other Council in
Scotland, yet Inverclyde refuse, what about all the transparency that the
Government talks about? I believe this question is in the public
interest as you represent the public, maybe Inverclyde Council have forgotten
this.

Im also disapointed in the time it took you to reply, you must have
known all what you wrote when you first received my request for
information, yet you kept me hanging on.

Not releasing this information now leaves me very suspicious.

I refer to your e-mail dated 25th February 2011 seeking a review of a
decision to refuse you information sought under Freedom of Information
(Scotland) Act 2002. In line with the guidance issued with the
legislation, I can confirm I was not involved with the original decision
to refuse you information, and have reviewed that decision entirely
independently of any other Council officer.

I have looked at the reasons given for refusing you the information, and I
disagree with the decision made. Accordingly I attach two spreadsheets
containing the information you sought.

Your e-mail of 25th February 2011 raises a number of questions and I will
attempt to answer those below where I believe I have a duty to respond:

How do you explain "public interest"? have you ever asked the publics
[sic] interest in "public interest"?

No; I have never asked the public to define for me what public interest
means. The public interest test is a statutory test that applies to
certain exemptions contained within the Act. Where one of those
exemptions is applied to a refusal notice, the authority is duty bound to
explain why the public's interest in withholding the information outweighs
the public's interest in disclosing it. However, the exemption used by
the decision making department (personal Information) does not require a
public interest test to be disclosed. It is an absolute exemption in
terms of the Act. The department making the original decision were merely
complying with the legislation. I would hope that this clarifies matters
for you?

I have received this information from every other Council in Scotland, yet
Inverclyde refuse, what about all the transparency that the Government
talks about? I believe this question is in the public interest as you
represent the public , maybe Inverclyde Council have forgotten this.

Inverclyde Council are tasked with making its own decisions and cannot
simply be led by what other Authorities are doing. The Inverclyde Council
takes its responsibilities both under this legislation and a myriad of
other statutes very seriously. You must understand that there are times
when information being sought should quite rightly be refused. In this
matter, the decision makers believed the information to be personal
information and did not release the information in order to protect this
personal information. I have addressed the question of "public interest"
above, and believe you are operating under a misunderstanding of the
legislation and when the public interest test comes into play.

I am satisfied that the response you received was within the statutory
timescales. Your request had to be looked at in accordance with the Act,
and accordingly it is wrong to suggest that a snap decision could me made
and relayed to you.

I hope the release of this information now alleviates any suspicions you
may have harboured. I can confirm that the decision was made in an honest
and transparent way. This was communicated to you in accordance with the
legislation.

I would advise that you have the right under s.47 of the Act to make an
application to the Scottish Information Commissioner in respect of the
Council's decision. if you remain unsatisfied thereafter, there is a
right of appeal to the Court of Session on a point of law. If you wish to
appeal to the Scottish information Commissioner, you must do so within six
months from the date of this communication.
