Investigatory Powers Act: documents relating to “filtering arrangements”

We're waiting for Open Rights Group to read a recent response and update the status.

Open Rights Group

Dear Home Office,

I would like to request a list of documents, such as explanatory documents, option papers or technical advice explaining the reasoning, intentions and functioning of Articles 67, 68 and 69 of the Investigatory Powers Act 2016.

I would also like a list of meetings held concerning these articles or the communications data “filter” during the period September 2015-November 2016.

Yours faithfully,

Jim Killock

Dear OSCTFOI,

I would like to refine and narrow this request, firstly to just a list of documents, such as explanatory documents, option papers or technical advice explaining the reasoning, intentions and functioning of Articles 67, 68 and 69 of the Investigatory Powers Act 2016, produced or obtained in the period January to May 2015.

I am only interested in documents made, received or considered by the lead team responsible for the contents of the bill, presumably at OSCTFOI. The search does not have to be made across the whole of the Home Office.

If this request still exceeds your cost limits, please reduce the search period to fit the cost limits, by focusing on the later part of the period January to May 2015. For instance, if a three month period can be made, please look for documents produced in March, April and May.

Yours sincerely,

Jim Killock

Dear OSCTFOI,

Thank you for your response re my request reference 44741 / 45505

In order to locate the material required, can I suggest that you narrow this down to papers or documents primarily focused on filtering arrangements and Articles 67, 68 and 69 as described below.

Thus if it is not immediately obvious (for instance from the title) that the document concerns these topics, the document does not need to be examined.

For convenience the request as previously refined is below:

Dear OSCTFOI,

Re: your response re my request reference 44741 / 45505 I am making below some further suggestions to help you meet cost limits.

In order to locate the material required, can I suggest and state:

(1) that you narrow this down to papers or documents primarily focused on filtering arrangements and Articles 67, 68 and 69 as described below.

(2) that you do not need to make an exhaustive search in any case. I will be satisfied with a reasonable and cost effective search, such as looking for titles of folders of documents, or using the search facilities provided by your electronic document file systems

(3) If it is not immediately obvious (for instance from the title, or the search facility) that the document concerns these topics, the document does not need to be examined.

For convenience the request as previously refined is below:

This response from the Home Office appears non-helpful.

Perhaps try an internal review?

Contact us if you would like us to un-redact that email address, though we recommend keeping communications on our website as much as possible.

How frustrating!
