Dear Mr Tennant

Further to your request for information below, could you please provide
some clarification.

Your question asks about ‘out of control’ dogs, however this is not a
category that our animal welfare team record. They record the categories
of:

·         Control of dogs

·         Dangerous dogs

·         Stray dogs

Can you clarify which of these categories you would like this information
for?

In the circumstances, I regret that your request cannot be formally
processed in terms of Freedom of Information legislation, until such time
as your request is clarified.

If you need any advice or assistance then please do not hesitate to
contact me.

Yours sincerely

Dear FOI - Generic Email Account,

Thank for your reply and I happy happy to clarify my request. and indeed give some background as to why I am asking these questions.
I am looking into the effectiveness of dog control law and regulations with a view to writing to all members of Scottish Parliament. The Control of Dogs (Scotland) Act 2010 gives powers to local authorities to issue "dog control notices". The clarification you require as to what I mean by "out of control" dogs is that I mean what is defined by the 2010 Act as described here https://www.legislation.gov.uk/asp/2010/9
I am not interested in stray dogs. As the Council will investigate allegations of dangerous or "out of control" dogs I am interested in those number of investigations and whether a recorded "informal" warnings or formal Dog Control Notices were given and the breeds concerned. I know some allegations may not for various reasons result in a warning or DCN but the fact that they have been investigated is still important.

Yours sincerely,

Mr Thomas Tennant
