Dear Foi (NHS NEL CSU),

Please can I just clarify your response. Are you saying that there were more than 0 but less than 5 inquests for each CCG, for every year requested?

If you're not please could you confirm which years had a nil return and specify the answer by CCG, as you've done with question 1 given these were separate FOIs to each CCG.

Many thanks
George

Dear Dr Julian

Further to your request for clarification, please see the additional
information provided below, on behalf of NHS Barking and Dagenham, NHS
Havering and NHS Redbridge Clinical Commissioning Groups, in response to
your original question 3a) and 3 b).

--------------------------------------------------------------------------

3a) the number of deaths of patients with a learning disability that have
resulted in an inquest in the last three years (defined as above)

NHS Barking and Dagenham, NHS Havering and NHS Redbridge CCGs do hold this
information.  Please see table below.

  1/4/16-31/3/17 1/4/17-31/3/18 1/4/18-present
NHS Barking and 0 0 0
Dagenham CCG
NHS Havering CCG 0 0 0
NHS Redbridge CCG 0 0 * Please see information
below

*NHS Redbridge CCG does hold this information. The CCG considers that this
information is exempt under Freedom of Information Act 2000, Section 40(2)
(personal information) as disclosure of this level of detail could lead to
the identification of individuals, which would be in breach of Data
Protection legislation. Although I cannot confirm the exact figure, I can
confirm that the number in each of these categories is less than five.

The Freedom of Information Act 2000 introduces a broader concept of risk
of personal identifiable information because its test for deciding whether
personal data can be disclosed is whether disclosure to a member of the
public would breach the data protection principles. This means that public
authorities have to assess whether releasing apparently anonymised data to
a member of the public would breach the data protection principles.

This is intended to ensure that public authorities take into account the
additional information that a member of the public might have (information
on the Web or in news reports, public libraries, court records etc.) that
could allow data to be combined to produce information that relates to and
identifies a particular individual - and that is therefore personal data.

Low statistical values increase the likelihood of seemingly anonymised
information being combined with other information to identify an
individual.

3b) of those inquests the number that were an Article 2 inquest

NHS Redbridge CCG does not hold this information.  Under the section 16
Freedom of Information Act 2000 duty to provide advice and assistance as
far as it is reasonable to expect it to do so, NHS Redbridge CCG has
confirmed that this information would be held by the Coroner’s Office.

Kind regards
