2) the number of independent investigations into the deaths of patients with a learning disability that you have commissioned in the last three years (defined as above)

3a) the number of deaths of patients with a learning disability that have resulted in an inquest in the last three years (defined as above)

3b) of those inquests the number that were an Article 2 inquest

Dear Tierney,

Many thanks for responding so promptly to my FOI requests FOI 30254 FG 10K / FOI 30255 SEH 10V. Can I just confirm that you are stating that the CCGs do not hold any information in relation to the deaths of patients with a learning disability? Despite being in an arrangement with a neighbouring CCG it would seem surprising that they have no overview of this population given their role as commissioner of health services for their local populations. Learning disabled people obviously access mainstream health services, in addition to any specific learning disability services.

It might be that you hold information relating to the deaths of people identified as someone with a learning disability in GP registers? Would there be any information on deaths of people with learning disabilities in the Joint Strategic Needs Assessment (JSNA) that the CCGs contribute to? Please could someone check and get back to me to confirm whether they really are not able to answer Question 1.

The Serious Incident Framework states the following in relation to Level 3 Independent Investigations:

'Although the regional team may offer support where it is necessary to do so, independent investigations, and the decision to commission independent investigations, should be managed locally by the commissioner of the care in which the incident occurred wherever possible. Local management and ownership of Serious Incidents is of fundamental importance to ensuring appropriate and timely action'.

Therefore I'm very surprised that the CCGs are unable to answer Question 2. Surely a record would be kept as to whether an independent investigation had been commissioned by a CCG or not? I wouldn't like to assume that no investigations have been commissioned but would appreciate confirmation either way.

I'll take it from your earlier response that you do not collect the information requested in Question 3.

I hope someone will be able to confirm with relation to the other questions,
