Investigate court fraud - where is this reported to other than the police ?

Response to this request is long overdue. By law, under all circumstances, Judicial Office for England and Wales should have responded by now (details). You can complain by requesting an internal review.

Dear Judicial Office for England and Wales,

Investigate court fraud - where is this reported to other than the police ?

Please tell me when evidence is found of falsified court documents that have been accepted by a court that should know they are not correct who should this be reported to ?

Please don't say the police as they would only pass it onto the cps who both work with the courts. Is there any independent separate service not connected with the courts and not an at arms length service to investigate what is happening within courts or are they paid to investigate themselves like most public services ?
Yours faithfully,

Mrs Julie Price

Evans, Brian (DJO-JSB),

Dear Mrs Price,

Thank you for your enquiry. It is not possible for this to be dealt with under the Freedom of Information Act 2000 (FOIA) since you have not made a request for recorded information, but rather have posed a series of questions. In addition, most of the subject matter of your enquiry is not something that could be answered by any information that might be held by the Judicial Office. Further information can be found at ICO website about making an FOI request at the following link:

https://ico.org.uk/for-the-public/offici...

However, on a discretionary basis and outside the scope of the FOIA, I can point you to general information concerning the accountability of judges which is publicly available on the judiciary website as follows:

https://www.judiciary.gov.uk/about-the-j...

With regard to court staff, it would be a matter for HMCTS as the employer to investigate initially. I understand there is an internal audit function which can be engaged. Where there has been criminal activity (such as fraud) it would be necessary to involve the Police. They will in turn liaise with the CPS to decide whether there is sufficient evidence to proceed with a criminal case. A conviction in Court can only be achieved if the Magistrates or the Jury in the Crown Court are persuaded by the evidence presented.

Dear Evans, Brian (DJO-JSB),

Thank you for being honest.

There is no real independent options and no real accountability or transparency and that basically you end up in the same courts you are complaining about, who either investigate themselves or services with connections to the court.

Yours sincerely,

Mrs Julie Price

You can submit a report to the police via the Action Fraud website (an example relevant to "court fraud" below):

https://www.scribd.com/doc/298448819/Act...

Not very successful though. It's the government's attempt to automate the detection of crime and at the same time saving money. It's effectively policing by computer database, as investigations are only triggered by the processing system being able to match certain key words and phrases from submitted reports.

That said, if enough people who are victims of this corruption, who do submit reports through Action Fraud, hopefully the system will find enough key words and phases to trigger the required police action.
