Under the Freedom of Information Act we are required to reply within 20
working days.  The Act does not specify a limit to the number of
information requests a public authority may receive or the number of
requests or questions an applicant may submit.  However, there are
exemptions in the Act that can apply and these include where the cost of
complying with the request would extend beyond the reasonable cost limit,
(currently 18 hours or £450), or if the request is otherwise manifestly
unreasonable in its scope or nature. 

 

Requests that ask a great many questions, or a number of detailed requests
submitted at the same time, may make it necessary for Essex Police to
refuse the requests wholly or in part. The exemption at s14 may be engaged
if the burden on the authority is increased through multiple requests on
differing subjects

 

The Information Commissioner’s Office (ICO) has responsibility for
providing oversight and guidance for the legislation and they have
produced advice for applicants on submitting effective requests.  Further

Dear Mr Scott. Thank you for your email dated 21 December 2018. I understand that you have submitted a complaint regarding the length of time that Essex Police have taken in regard to FOI requests.

Our records indicate that you have made three requests for Information.

3FOI 10626 - Request for copy of Internal Intranet Page - Received on 03/10/2017 - This appears to be a duplicate of FOI 10095 which had already been answered

Please accept our sincere apologies in regard to the delay in responding to your request 10626 within the statutory 20 days. Unfortunately we did not send a written apology explaining the extent of our current backlog and anticipated delay, nor an apology and explanation within the final FOI responses which is unacceptable. The last year has been difficult within the DP/FOI team due to the high number of outstanding requests as a result of resourcing and high demand within the department. Although this does not excuse our failings, steps have been put in place, (communicated with the ICO) to improve the situation. Extra resources have now been provided and all work within the wider team, including FOI (from the middle of Oct) has been dealt with in regard to meeting compliance targets. The next strand of action within the FOI team is to continue providing a service in respect of the new requests and equally deal with the oldest outstanding cases in order to bring our numbers to an acceptable level.

Again I must apologise for our lack of communication and service but I can assure you that the situation is changing and improving.

From my records, we have responded to all requests submitted by yourself , I have however for aid attached the reply for your reference.

This unit has had a substantial increase in FOI requests which has resulted in a considerable delay to the service provided from this unit. This has now been addressed and Essex Police responses are now strictly applied to be within the accepted tolerance parameters required by the ICO.
