Please accept our apologies in respect of the delay you have experienced,
we have not met the standard of service expected in respect of timeliness.
To explain, we are currently upskilling our workforce in the specialist
area of Freedom of Information, so that we are better equipped to meet the
growing demand for information under this right. We are working hard to
improve our service in this area. 

 

We are now in a position to dedicate time to review our outstanding work
and can respond as below. 

   

The Freedom of Information Act 2000 (FOIA) places two duties on public
authorities:    

   

Unless exemptions apply, the first duty (at [1]Section 1(1)(a) is to
confirm or deny whether the information specified in a request is held.   

The second duty (at [2]Section 1(1)(b) is to disclose information that
has been confirmed as being held.    

However, where exemptions are relied upon ([3]Section 17 of FOIA), there
is a requirement to provide the applicant with an explanation either:  

a) stating the fact   

b) detailing the exemption(s) in question and  

c) why the exemption applies (if not apparent).

Exemption [4]Section 31(1)(a)(b) Law Enforcement,

  

[5]Section 31(1)(a)(b) Law Enforcement is a prejudice based qualified
exemption and there is a requirement to articulate the harm that would be
caused in releasing all information that is held as well as carrying out a
public interest test.

 

Evidence of Harm -

Disclosing full details held on the internal Essex Police Intranet front
page would provide a person who may be intent on criminal activities with
invaluable information as to the capability / tactical position specific
methods and intelligence collected by Essex Police. This awareness would
reveal vulnerabilities which would ultimately compromise police tactics,
operations and future prosecutions as criminals could counteract the
measures used against them. 

Any information that undermines the operational integrity of our systems
and activities will adversely affect public safety and have a negative
impact on local and National Security.

Essex Police can report as follows:   

Caveat: The information is correct as of 13/02/2025. 

The attached PDF is a copy of a snapshot in time of the Essex Police
Intranet Home Page, taken on 13/02/2025.  Redactions are completed to
protect personal information and sensitive data.

No further information will be provided by virtue of the [6]Section
31(1)(a)(b) Law Enforcement and [7]Section 40(2) Personal Information –
this is an absolute exemption.

Factors Favouring Disclosure

Police Forces need to be properly equipped in order to meet the demands
placed upon them and this information could go some way towards reassuring
the public that Essex Police is adequately prepared in this area. The
Force is responsible for public money and therefore there is a strong
public interest in disclosing how and what the money is spent on.

Factors Against Disclosure

Disclosing the full details of the intranet front page that are not in the
public domain, allows for certain policing activities to be carried out
with the minimal possibility of being disrupted. To disclose the full
details of the intranet front page requested may allow criminals to
determine what intelligence is being gathered. This would aid criminal
activity by enabling individuals to undermine and disrupt policing
activities. Therefore, exempting some details is primarily to protect the
systems and Teams that could be targeted for the purpose of disrupting
general law enforcement activities and functions.

Balancing Test

Whilst there is a general public interest in being open and transparent
about how and where public money is spent and the services that we
provide, there is a greater public interest in protecting our policing
abilities. Information identifying the details of specific policing
activity, within this FOI request, could be used to the advantage of
criminals. Information that undermines the operational integrity of these
activities will adversely affect public safety, and have a negative impact
on law enforcement.

 

Therefore, it is for the reasons outlined above that it is decided that
the public interest weighs in favour of partial disclosure.
