Please provide any information/documents as to how the force will deal
with interviews under caution that may be required when a person has not

I am writing to advise you that I am unable to process your request as it
does not conform to the requirements of the Freedom of Information Act in
the following area:

 

Section 8 of the Freedom of Information Act states:

 

In this Act, any reference to a ‘request for information’ is a reference
to such a request which-

 

(a) is in writing

 

(b) states the name of the applicant and an address for correspondence

 

(c) describes the information requested

 

You have not stated your name. Where a request is received and the
applicant is either anonymous or suspected to be using a pseudonym, there
is no lawful requirement to deal with this under FOIA because the
criterion defined under Section 8 is not met. A first name or surname
provided in isolation is not sufficient to meet the Section 8 requirement.

Therefore I would request that you provide identification. Please could
you either scan and email or post to us a copy of documentation to confirm
your identity.

 

If we do not receive a reply by the 22/04/2020 I will consider that you no
longer require this information and your request will be closed

 

I trust you find this information to be satisfactory but if you have any
further queries please do not hesitate to contact me.

  

 

Northamptonshire Police provides a review and appeals procedure within
the  terms of the Freedom of Information Act 2000. If you decide to make
an appeal and, having followed the full process you are still
dissatisfied,  you will then have the right to direct your comments to the
Information Commissioner who will give due consideration to the matter.

Unfortunately we are still unable to verify your identity using the
information that you have newly provided in relation to Section 8 of the
Freedom of Information Act 2000.
 
Here is a link to the Information Commissioner's Office guidance on
Section 8 of the Act:

and I would draw your attention to the advice relating to Section 8(1)(b)
which states that:

In the guidance the section on page 6 "Name of the applicant" point 14
states:
 
"14. A requester can be an individual, a company or an organisation, but

In the Guidance the section on page 22 "Requests made through What Do They
Know.com or Social Media" point 106 states:
 
"106. Requests made through the whatdotheyknow.com website will be valid,
provided the requester supplies their real name and describes the
information concerned."
 
As previously requested, please supply your identification to accompany
your request by the deadline of 22/04/2020  or I will consider that you no
longer require this information and your request will be closed.

I am writing to request an internal review of Northamptonshire Police's handling of my FOI request 'Interviews under caution during corona virus'.

1. The force has been provided with sufficient information for our request to be progressed.

2. We are a company who have provided sufficient information to set up a website and are also registered with the Information Commissioner's Office.

3. In our last communication we stated that if the case worker was not going to progress our request that we would like the request elevated to an internal review which the caseworker failed to do.

I write in response to your email referring to an internal review. This request makes three statements therefore I am not certain that I am fully clear of what you require.

Northamptonshire Police provide an internal review process as per guidance provided by the Information Commissioners Office. It is advised that where an internal review process is available it is to consider a dispute where the requester disagrees with an interpretation of the request, the requester believes the authority holds more information than they have disclosed or the requester is awaiting a response and unhappy with the delay.

To date Northamptonshire Police are awaiting additional information to be able to process your request, information that will support the authenticity of the requester, in this case that the application in the name of an organisation is as it has been given.

Because there is no misinterpretation of a request, no dispute at this time about the amount of disclosure made and there is no response date to work to as yet, there is seemingly no criteria met to carry out a review.

Please respond to our previous communication to authenticate the request that is being made in the name of the organisation or alternatively in the name of an individual and the request will be logged and responded to accordingly.
