Dear British Broadcasting Corporation,

I am aware that TV Licensing conducts around 400,000 Interviews under Caution each year.

Please can you tell me (for any relevant period of time, conducive to reporting within the cost limits for Freedom of Information)...

1. In what proportion (or number) of Interviews was the Interview temporarily delayed to permit the interviewee to obtain legal advice (i.e. by phone and with the TV Licensing interviewer remaining on the interviewee's premises)?

2. In what proportion (or number) of Interviews was the Interview deferred (to another day) to permit the interviewee to obtain legal advice?

3. In what proportion (or number) of Interviews was the Interview abandoned after the interviewee had exercised their right to obtain legal advice?

4. Any discussion documents, e-mails, etc. relating to any comparisons between the prevalence of TV Licensing interviewees to obtain legal advice compared to defendants being interviewed about other, similar allegations by other agencies.

I really don't think they're going to hold information in that level of detail. Even if they did, I'm sure they'd somehow manage to avoid providing a response.

The BBC really doesn't want people to know that saying "I want to consult a lawyer" is enough to stop TV Licensing in its tracks... oops!

It will be interesting to see what their response is.

Personally, I think that this is the kind of information that they could easily capture and if it were favourable to them (a reasonable number of interviewees obtained legal advice), then I would expect them to proudly publish it.

I am writing to request an internal review of British Broadcasting Corporation's handling of my FOI request 'Interviewees exercising "Right to Counsel"'.

The BBC has stated its grounds for refusing my request as being that the Act requires a valid name. Whilst this is true, the ICO also states a number of criteria under which a requester's name is deemed valid, including "that a request can be made in the name of an organisation". This is the basis for my use of the phrasing: "Mark on behalf of LicenceFree.co.uk" in my request.
