2a) Please confirm whether the university trains/teaches the relevant employees/administrators on when and how to report international students to the Home Office for immigration enforcement purposes.

2b) Please provide a copy of any guidance or policy(ies) that are used to inform relevant employees/administrators on when to report students to the Home Office.

3) Please include any other relevant policy(ies) or guidance used by the university related to compliance with immigration enforcement, as it relates to international students.

Dear Mahlea

I acknowledge receipt of your email  received by this office on 12th May
2021.  

 

Your request will now be dealt with under the Freedom of Information Act
2000 and has been allocated reference FOI21-200 which should be quoted in
all correspondence. We will respond to your request within 20 working days
starting the next working day after receipt, therefore you can expect to
receive a response no later than 10th June 2021.

 

Please note that in order to fulfil your request we need to liaise with
other teams across the University. Due to the Coronavirus pandemic most
staff are now working remotely and have intermittent access to information
held in hard copy. Staff may not be able to assist as they may need to
prioritise other work, cover for colleagues who are ill or be away from
work themselves due to illness. However, we will do our best to meet this
deadline and keep you informed should we be unable to do so. 

 

Where we consider that we will not be able to meet the deadline or if
further time is required to consider the public interest test we will
contact you as soon as possible and give you a revised date for response. 

 

In some circumstances a fee may be payable and, if that is the case, we
will let you know. A fees notice will be issued to you, and you will be
required to pay before we will proceed to deal with your request.

I am writing in response to your Freedom of Information request dated 5^th
May 2021.  

 

For ease of reference, we have set out your questions below, together with
our responses:  

 

1a) Please provide a copy of any agreement between the university with the
Home Office that is used for immigration enforcement purposes and/or
policy governing the sharing of data related to international students. 

 

The University’s Student and Applicant Data Protection Notice [1]Student
and applicant data protection notice - Public information - Cardiff
University sets out how we deal with the personal information of people
who are applying to, or studying at, the University and the purposes for
which personal data will be shared in accordance with Data Protection
legislation.  

 

As a Tier 4 sponsor, the University has a duty under UK Visa and
Immigration legislation to share data when legally required to do so.   

 

University staff follow Home Office guidance in regard to our reporting
duties in relation to International Students, which can be found here:

Information provided to international students regarding visa requirements
to study at the University can be found on our website: [3]Visas and

Information for international students, which explain when the University
needs to report to UKVI is available on our Student Intranet. That
information has been reproduced on the attached document ‘FOI21-200
Student Intranet visa rues and responsibilities’.

Relevant staff are trained in accordance with the Home Office guidance
noted above.  

 

2b) Please provide a copy of any guidance or policy(ies) that are used to
inform relevant employees/administrators on when to report students to the
Home Office. 

 

Information for all University Staff is available on our Staff Intranet.
That information has been reproduced on the attached document ‘FOI21-200
Student visas and immigration compliance’’. 

3) Please include any other relevant policy(ies) or guidance used by the
university related to compliance with immigration enforcement, as it
relates to international students.
