Internal guidelines covering Off-payroll working legislation (IR35)

In April 2017 Government introduced new rules into the public sector called the off-payroll reforms, commonly referred to as “IR35”.

I am interested in obtaining a copy of your internal guidelines being used when on boarding flexible workers, or contractors, where the Off-payroll rules (IR35) might apply.

Please can you:
1. send me a copy of your internal guidelines used for any internal guidance,
2. send me any policies you use surrounding the reforms.
3. send me any documents you use to explain your policies to agencies who supply workers to you.
4. Send us me internal guidance explaining how you assess the status for each contractor.

The tax affairs of Docklands Light Railway Limited, including compliance
with the off-payroll working legislation, are managed in the same way as
the whole of the Transport for London group, this response is therefore
not specific to Docklands Light Railway Limited. Operation and maintenance
of the Docklands Light Railway is under a franchise with the private
sector, therefore we are unable to comment on workers engaged by the
franchisee.   

 

Transport for London does not engage workers via personal service
companies. As all NPL are engaged via agency or umbrella PAYE, the
off-payroll working legislation does not apply. Transport for London use a
managed service provider to supply NPL who support us with implementing
this policy.
