The request was made on 7th December but the reply was not given until 12th December which was beyond the 20 working days limit, yet the response was not complex in any regard.

I would like to see all the information regarding this request both internal to PHSO and any external data. This would include emails, phone transcripts, written notes etc.

I write in response to your email of 10^th February 2018 where you raised
concern regarding the time taken to complete a Freedom of Information
(FOI) request submitted to the Parliamentary & Health Service Ombudsman
and requested to see all information regarding this request. You stated
the following:

was not complex in any regard.

 

I would like to see all the information regarding this request both
internal to PHSO and any external data. This would include emails, phone
transcripts, written notes etc. 

 

We are treating your email as a request for an internal review and a meta
request for all information held relating to the handling of the request.

 

With regards to your meta request, we note you submitted a request on 7^th
December 2017 and a follow-up request on 23^rd January 2018. As these
requests are on the same subject we have considered both of these requests
as part of your meta request. Please find attached all the information
held relating to the handling of FOI requests FDN-274943 and FDN-275010. A
small amount of information relating to staff names has been withheld
under Section 40(2) of the Act as this information constitutes personal
data.

 

With regards to your internal review, the purpose of such a review is to
assess how your FOI request was handled in the first instance and to
determine whether the original decision given to you was correct. This is
an independent review. I was not involved in the original decision.

 

I have reassessed your case and after careful consideration I have
concluded that the response sent to you was partially compliant with the
requirements of the Freedom of Information Act. An explanation of my
decision follows.

 

Your original request, dated 7^th December 2017, asked for the following:

 

‘At a recent meeting with Rob Behrens, Ombudsman he informed us that PHSO
had a design team. Can you tell me what is the remit of the design team,
who are the members and who do they report to?’

 

Our response (reference FDN-274943) dated 12^th January 2018 was issued to
you outside of the statutory time limit prescribed by the Freedom of
Information Act of 20 working days as specified at Section 10(1) of the
Act. Having reviewed the records held showing the handling of this
request, whilst every effort was made to obtain the required information
in a short period of time, the request met with delay when the FOI/DP
Officer requested assurance over the accuracy of the proposed response.
This then met with a further delay when seeking approval over the final
revised response.

 

In terms of the content of the response issued, which stated:

 

I am writing in response to your email received 7 December 2017 in which
you have made a request for information held by the Parliamentary and
Health Service Ombudsman (PHSO) under the Freedom of Information Act 2000
(FOIA). Please accept our sincere apologies for the delay in our response.

 

Your exact request was:

 

‘At a recent meeting with Rob Behrens, Ombudsman he informed us that PHSO
had a design team. Can you tell me what is the remit of the design team,
who are the members and who do they report to?’

 

I can confirm that the PHSO do not have a ‘design team’. There is however
a staff team known as the Design Authority whose remit is to maintain and
process documentation, and to manage any normal conduct of business
changes to policy and process. The Design Authority team are located in
the Operations Directorate and currently managed by Chris Morgan, Director
of Quality & Service Integrity.

 

I am satisfied that Section 1(1) of the Act has been met by confirming the
PHSO do not have a ‘design team’ as specified in the request. The response
then clarified that there is a ‘design authority team’ along with
confirming their remit, which Directorate they were located and who they
were managed by to answer the request. The response also included an
apology for the delay.

 

In light of the efforts made to ensure a full response was provided,
whilst impacting on the statutory deadline, I am satisfied that Section
16(1) of the Act has been met.

 

In conclusion I consider the response provided was partially compliant
with the terms of the Freedom of Information Act. Whilst the response was
complete it was late which did not fulfil our obligations under Section
10(1) of the Act.

 

I note your follow-up request (FDN-275010) did not meet with delay and the
response was issued within the statutory time limit.

 

I hope that this response has provided what you require. You have the
right to appeal our decision if you think it is incorrect by submitting a
complaint to the Information Commissioner’s Office ([2]www.ico.org.uk).

Dear InformationRights,

thank you for your comprehensive response. Given there has been some confusion regarding the Design Authority can you tell me when this body first came into existence at PHSO?

On 9 January 2018 Chris Morgan states that "The design authority basically own the guidance and process documentation and manage BAU change to policy and process ..." Can you tell me what BAU stands for?

On 10 January 2018 Karl Banister wrote "Hi See below. This is the answer" There is no further text. Can you send me the text which would constitute 'the answer' or explain why this information cannot be disclosed in line with the FOI regulation?

Thank you for your reply.

We can confirm that the Design Authority Team have been in place since 31st December 2016.

BAU stands for 'Business as Usual'.

With reference to your final question regarding the email dated 10th January 2018, the text 'this is the answer' is referring to the email trail below this text. Specifically, it was referring to the email discussions you can see below dated 9th January 2018 at 18:04pm, 10th January 2018 at 00:34am and 10th January 2018 at 08:52am. Mr Bannister was therefore advising the FOI Officer that the email trail below was the answer. There was no attachment to this email.

I can confirm we have disclosed all information held in relation to the handling of these requests, there is nothing further we can provide.
