I apologise for the delay in our response, however upon consideration of your request, it has been identified that sections 30 (Investigations) 36 (prejudice to the effective conduct of public affairs) and 40 (Personal Information) are engaged, in relation to some of the information contained within the report.

As a result we are not yet in a position to respond fully to this request. We will now respond in full confirming the outcome of the public interest test as soon as possible, but in any event within 5 working days.

Dear Mr. Wren,

I apologise for the delay in our response, but can confirm that we have
now fully considered the appendices for disclosure.

I can confirm that some information identifying individuals, has been
identified as "personal data" as defined by the Data Protection Act
1998. As a result, this information is exempt in accordance with
section 40 of the Freedom of Information Act 2000. This particular
information has been withheld and indicated on the enclosed appendices.

Section 30 - (Investigations and Proceedings), is engaged in relation
to specific information contained within the appendices. It is
considered that disclosure of this particular information at this time,
would prejudice the Council's ability to carry out ongoing
investigations.

Section 31 - (Law Enforcement) is engaged in relation to specific
information contained in the appendices. It is considered that
disclosure of this particular information at this time, would be likely
to prejudice the prevention or detection of crime and the apprehension
or prosecution of offenders.

Although the city council aim to be transparent and accountable to the
public, the above exemptions have been carefully considered and have
been applied only to information that would prejudice law enforcement
and investigations carried out. As a result, this particular
information has been withheld at this time. As a result, I now enclose
a copy of the appendices with all exempt information withheld.

This response should answer your request in full, however if you are
not satisfied with this response or wish to lodge an appeal against any
exemptions that may have been applied, you can do so by writing to the
Data Protection Officer at Bristol City Council Legal Services, The
Council House, College Green, Bristol, or [Bristol City Council request email]. Details
of the complaints procedure can be found at
http://www.bristol.gov.uk/complaints.

If, after you have exhausted the council’s complaints procedure, you
are still not satisfied with the response you have received you have the
right to complain to the Information Commissioner, details of your right
to complain can be found at http://www.ico.gov.uk/complaints.aspx
