Thank you for your request for information that was received on 5 November
2018 concerning:
 
Can you please provide us with all the Information you have about
Beechholme Children's Home in Banstead Surrey,Which Closed in 1974.
Especially any information you may have of the Council carrying out any
internal Abuse Reports or any reports the council might have about Abuse
at Beecholme Between 1950 and 1970.
 
We are dealing with your request under the Freedom of Information Act

In your email to RBKC dated 7 December 2018, you raised the following
issues with your recent FOI request.
 
In your request for a review you asked;
 
'Could you please chase up any reports you have and look in to our request
at the earliest opportunity'.
 
This was in relation to the response to your recent FOI request as
detailed below.
 
Request
 
'Can you please provide us with all the Information you have about
Beechholme Children's Home in Banstead Surrey,Which Closed in 1974.
Especially any information you may have of the Council carrying out any
internal Abuse Reports or any reports the council might have about Abuse
at Beecholme Between 1950 and 1970'. 

Response

This request is being handled under the Freedom of Information Act 2000.

I can confirm that Royal Borough Kensington and Chelsea holds the
information you requested. However we are withholding that information
since we consider that the following exemptions apply to it.

This information is exempt from disclosure under Section 31(1)(a)(b) of
the Freedom of Information Act: Law Enforcement. The information relates
to investigations and proceedings which are still on-going. To use this
exemption we are required to undertake a public interest test. The matters
which were considered in applying the public interest test are as follows:

Factors in favour of disclosure

Public may be interested in finding out any information that can shed
light on the events at Beecholme Childrens Home.

Factors in favour of withholding

However disclosing the requested information at this stage is likely to
prejudice any enforcement action that the council and the police may
consider. It is considered that the greater public interest therefore lies
in not providing the information at this time. In coming to that
conclusion, the public interest in providing the information has been
carefully weighed against any prejudice to the public interest that might
arise from withholding the information; in all the circumstances of the
case, the public interest in maintaining the exemption outweighs the
public interest in disclosing the information.

This response therefore acts as a refusal notice under section 17 of the
FOI Act.

 
Review decision
 
The final decision of this review is that it does not uphold
your complaint. Having looked again at the original decision to withhold
this information I am happy that the public interest test undertaken was
fair and adequate in relation to the exemption that was used. 
 
Section 31 (1) (a) & (b) relates to information which is not exempt by
virtue of section 30 and is exempt information if its disclosure under
this Act would, or would be likely to, prejudice the prevention or
detection of crime or the apprehension or prosecution of offenders. I am
satisfied that this exemption has been correctly used in this case.
 
If you are not content with the outcome of this Internal Review you have
the right to apply directly to the Information Commissioner's Office for a
further decision. The Information Commissioner can be contacted at:
