Response due by 11 January 2021

reminder sent and acknowledged.

Pomery Charlotte,

Dear Mr Burnham,

Thank you for your request for information received on 10 December 2020,
our reference: LBH/10581520.

You asked about any funding or income advantages to Haringey Council for
all intergenerational living schemes and also specifically mentioned Lowry
House/Clements House/Brookside House.

I apologise for the delay in our response, I believe that Homes for
Haringey have responded under separate cover and we believed they had
amalgamated our response with their own. For the removal of any doubt
there is no financial benefit to the council of piloting the
intergenerational service, it has cost us more to commission the support
than it has saved elsewhere. The reason for doing it was not about
cost-saving but to trial the approach and understand more about the
benefits of intergenerational living.

If you are unhappy with how we have responded to your request you can ask
us to conduct an Internal Review. If so, please contact the [1]Corporate
Feedback Team.  (Please note you should do so within two months of this
response.)

Yours sincerely,

Due Friday 9 April 2021

Dear Homes for Haringey,

Freedom of Information Request: LBH/10581520

The above request was sent to you on 10 December 2020 (four months ago).

I am now requesting an Internal review.

I have not yet received an answer to this part of my question: "Please provide copies of all letters sent to residents of Lowry House, Clements House, or Brookside House, regarding the proposal to initiate the 'Trial' intergenerational living scheme which began in 2019."

On the 24 March, you advised me that you had sent an internal message requesting that I be provided with a substantive reply on this matter within 10 working days. I would therefore have expected a reply by the end of Friday 9 April. As a full reply to this request is long overdue, I would be grateful for a full response to this question at your earliest convenience.

I note that a partial response to this request from Charlotte Pomery of Haringey Council on 2 March 2021 stated, ‘I believe that Homes for Haringey have responded under separate cover and we believed they had amalgamated our response with their own.’

However, I have received no such substantive FOI response from Homes for Haringey. If it exists, please may you find it and send it to me, without delay.

As the full response to this FOI question was due three months ago, according to the provisions of the Freedom of Information Act, I request that you consider whether some financial compensation is appropriate, in view of your failure to respond to the substance of this request in full, in a timely manner.

I believe that you have breached your standards of good practice and courtesy in failing to reply, and also that you do not have processes and systems in place with capacity to respond to this question within the provions of the Freedom of Information Act.

With all things considerely, your response to this question has been grossly inadequate.

Please could you respond to all of the matters raised in this email.

Yours faithfully,

Paul Burnham

Dear Mr Burnham,

Internal Review of the Freedom of Information Act/ Environmental
Information Regulations request reference LBH/10581520

Thank you for giving us an opportunity to review the response we have sent
to your Freedom of Information / Environmental Information Regulations
request.

You have commented:

However, I have received no such substantive FOI response from Homes for

Please find below my response:

I sincerely apologise that you were not sent the copies of letters sent to
residents of Lowry House, Clements House, or Brookside House. There was
some confusion between officers about information provided to Homes for
Haringey that should have passed to you. I find that we have failed in our
obligations on this matter under the Freedom of Information Act. I have
highlighted this case to the service as a failing.

I have attached the letters that we hold on record which are related to
your request as part of this response. I am advised that there are no
consultation documents related to Clements or Brookside.

I hope that you are satisfied with my response to your request. If you are
dissatisfied, you may complain to the Information Commissioner, who may be
able to help you.  Please note that if you wish to refer this case to the
Information Commissioner, they normally ask that you do so within two
months of our response to you.

Dear FOI,

Thank you for your reply of 7 May, which contains very useful information.

Simon Dingomal, Corporate Feedback Officer, has written, "I find that we have failed in our obligations on this matter under the Freedom of Information Act."

However I note that you have not responded to this part of my request for an internal review: "As the full response to this FOI question was due three months ago, according to the provisions of the Freedom of Information Act, I request that you consider whether some financial compensation is appropriate, in view of your failure to respond to the substance of this request in full, in a timely manner."

You should have responded to this part of my Internal review request, whether or not you were to agree with it.

I am dissatisfied with the inordinate length of time that it has taken to provide the full information (the reply was due by 11 January, but was not provided in full until 7 May) ; and the number of additional prompts and further messages which were required during that time. Can you please now consider my request re. financial compensation, regarding your poor performance in this matter.

Yours sincerely,

Paul Burnham

Substantive reply received 7 May. Second request re. financial compensation sent 12 May.

Dear Mr Burnham,

Thank you for your email below and I apologise for our delay in responding
to you.  I’m afraid however that we do not award financial compensation
for failing to comply with the Freedom of Information Act. I apologise
this was not made clear and that your request was not addressed in the
Internal Review response. Fault was found in how your request was dealt
with and the findings were explained in our response to you.

I realise this response may be disappointing to you.  As advised in the
response to the internal review, if you remain dissatisfied with our
response you can approach the Information Commissioner’s office.

Yours sincerely,
