In response to two other FOI requests [1][2], you have announced your intention to publish a list of Post Office Branches as at 31st March 2015. I would like to request some additional information about this, in order to help me understand if this potential release will provide the information I was previously seeking.

1/ When was this intention formed, and by whom?

2/ What is the expected / anticipated time scale for this publication to occur?

3/ What information will be (or is being considered to be) provided about each branch?

4/ What format(s) are the data expected (or being considered) to be released in?

5/ Under what licence(s) (if any) are the data expected (or being considered) to be available for re-use?

I am writing to request an internal review of Post Office Limited's handling of my FOI request 'Intention to Publish Post Office Branch List'. A full history of my FOI request and all correspondence is available on the Internet at this address: https://www.whatdotheyknow.com/request/i...

In your response, you claimed that you do hold the information that I requested, but that it is exempt from disclosure under FOIA s22 ("Information Intended for Future Publication"). As I am sure you are aware, s22 is a qualified exemption, and so is subject to a public interest test. I see no evidence of any such test being carried out in your response. (See the ICO's Guidance at [1].)

Furthermore I can see no public interest in withholding the information in my points 1-5 at this point in time. On the contrary, there is a strong public interest in releasing it to place on record exactly what you intentions are relating to the publication of your Branch List. It will be most useful for those who would like to be able to use (or re-use) the Branch List information, to know what is likely to be released, on what timescale, and under what licence. It may also have an impact on other FOI requests and complaints relating to existing requests. Positive answers to my 5 questions, could make further requests and complaints moot, saving public authorities the administrative burden of dealing with them.

Secondly, I would argue that in any case s22 does not apply to the information I have requested here. While I accept that you now have an intention to publish the list of branches, that is not what I was asking for here. While the final decision on points 2-5 that I asked about will become obvious if/when the Branch List is published, things could change between now and then. I very much doubt that you had a settled intention to publish your current plans for 2-5 at the time I made my request. I also doubt that you had any intention to publish details of who made the decision and on what data this occurred (item 1). Without such a settled intention to publish, s22 cannot be engaged.

Dear FOIA,

Many thanks for your response to my request for an internal review. Unfortunately, I see no evidence in your review that you had a settled intention to publish the specific information I asked for at the time of my request, nor any explanation of why there would be any public interest in favour withholding the information at this time. In the absence of either of these details, section 22 cannot be relied upon to withhold the information. I will therefore be making a complaint to the Information Commissioner.

Dear Kerry Moodie,

Many thanks for your response, and the helpful information that you have now provided. It is great that you intend to publish the list in an open and re-usable format, and that you are intending to licence the data for re-use. However it is most unfortunate that you are planning to use the NCGL, as this is a non-open licence that severely restricts the way in which the information can be re-used. It would be much better for potential re-users if you were able to licence the information under a licence that meets the Open Definition -- see http://opendefinition.org/ .

Secondly, you stated that you intended to publish the list of branches on the 15th January 2016, and that it could be accessed via http://corporate.postoffice.co.uk/access... . However, it is now 17th January I am unable to find any link to the new dataset there. In particular, in the "Lists and Registers" section of the "Annex", the only item is a link to your existing "Find a Branch" tool, and I can't find the list there either. Is this an oversight on your part, or has the publication date been put back for some reason?
