A. What is the maximum amount of insurance cover provided by West Midlands Ambulance Service NHS Foundation Trust for its front line staff, including volunteers, in the event of personal injury or accidental death whilst on duty?

B. With which insurance company is this cover arranged?

C. Please provide a link to the document which identifies and details the personal injury and accidental death insurance cover for volunteers, including Community First Responders, whilst they are responding to calls on behalf of West Midlands Ambulance Service NHS Foundation Trust.

Thank you for your reply and for your response that addressed part of my information request. However there are sections of the request for which you have not provided a response.

1. You state that: 'In addition, the Trust has: cover for Personal Accident (Occupational Related Cover) for Accidental Death of employed Specialist Trained staff e.g. Air Crew (not pilots) with a limit of £100k, but all non-specialist staff are covered as well up to £25k'.

Please provide clarification as requested:
You state “employed … staff” but do not state “CFRs” or “Authorised Volunteers” under this section as you have in the first section. As per the original information request, what Personal Accident or Accidental Death cover is there for CFRs and to what value? Do CFRs count as “Specialist Trained Staff”, “Non-specialist Staff” or neither? This is not clear.

2. You state that: 'The Trust has: - cover for all employees and CFRs involved in a Terrorist Incident with death and disablement benefits which are salary dependant'

Please provide clarification as requested:
CFRs are included in this section but you state that benefits are “salary dependent.” CFRs are volunteers and receive no salary from the service. Does this mean that they have no death or disablement cover through WMAS for Terrorist incidents, or that cover will be dependent upon the CFR's own professional/employment salaries?

Please provide clarification in order to answer the original information request.

These are not new requests for information as your reply has not provided an adequate response to the initial information request.

I am writing to request an internal review of West Midlands Ambulance Service NHS Foundation Trust's handling of my FOI request 'Insurance cover (personal injury, death) for WMAS staff and volunteers'.

I have not received an adequate response to my query. I received an initial response which did not address the questions as asked. I provided additional clarification and was told I would receive an updated response. This has not arrived. Please can you investigate this and provide me with an appropriate and complete response to my query as soon as possible. This FOI is well overdue an appropriate response.

Dear Karen Freeman,

Thank you for your reply. I've shared this information with others to ensure that I am understanding your response correctly. Your response states that:

'The insurance company that provide our personal accident cover have confirmed that it is
standard wording to include CFRs however, as our CFRs are volunteers they are not paid a
salary by the Trust and therefore are not covered under the personal accident insurance'

I interpret your response to state that volunteer Community First Responders are NOT covered for compensation in the event of injury or death whilst responding to ANY assigned 999 call.

As a final part to this enquiry, please can you confirm that I have interpreted your response correctly?

If it is the case that CFRs are not covered for compensation in the event of personal injury or death whilst on an assigned call or 'usual operational duties' (as you state), this is likely to be of interest to all volunteering CFRs across the WMAS locality.

Further to the below, we confirm CFRs are not covered by the additional Personal Accident cover or PA Terrorism cover which the Trust purchases, as they are not specialist trained staff and/or salary dependent as per our original response (re-attached for your reference). They are covered under the NHSLA Liabilities to Third Party Scheme (LTPS).
