Freedom of Information, East Sussex County Council

Dear Mr Basquiat

FOI Request ref:  5640 / Claims value 2015

Thank you for your request for information about the above, which has been
dealt with under the terms of the Freedom of Information Act 2000 (FOIA).
Your request and our response are set out below. Please note that any
information we provide is subject to the copyright and reuse of
information terms and conditions set out at the bottom of this email.

REQUEST

Could you please provide the value of claims for the year ending March
2015 as you have done for year ending March 2014?

RESPONSE

The total value of all payments made in the period 1^st April 2014 – 31^st
March 2015 against all insurance policies (including those that we self-
insure) was £2,123,095.

These amounts would have been paid against claims made in a number of
different financial years, it just so happens they were paid in the above
period.

I am unable to provide the value of the claims actually made in the period
as the estimated value will change during the life of the claim according
to the activity on it and information received (both up and down).

It must also be remembered that over 70% of all public liability claims
are repudiated. The initial value of claims made is therefore not
particularly useful. Furthermore there would be no relation between claims
made in a financial year and the amounts paid given the length of time it
can take to settle litigated public liability claims (several years in
some cases).

I hope that this answers your enquiry. If you believe that the County
Council has not complied with the FOI Act in responding to your request,
you may ask for an internal review. If you wish to do so, please set out
the grounds of your appeal in writing to:

Sudhir Basquiat

Dear Jeremy,

Thank you very much for your response, and for taking the time to provide the explanation you did. I understand the point you're making, but do you happen to keep a record of what the initial claim value was in each case? I recognise that this often has little resemblance to the final amount settled.

Yours sincerely,

Sudhir Basquiat

Freedom of Information, East Sussex County Council

Dear Mr Basquiat,

I am sorry but we are unable to assist you. We do not hold the information. When we set the claim up there is an initial estimated amount for the claim but this is amended as the claim progresses because the Council needs an accurate estimation of its total liability at any point in time. There is no requirement to keep the original claim amount because the figure becomes irrelevant as the claim progresses.

Yours sincerely
