I write to request the following information relating to your authority’s public liability (further narrowed down to Personal Injury claims) insurance claims management arrangements.

I prefer to receive your authority’s response in electronic format at this email address.
If for any reason you feel this request is unclear, please do not hesitate to contact me for clarification.

1. Who is your authority’s public liability insurance provider?
2. Does your authority’s insurance provider handle claims on your behalf? Yes/No
3. Does your authority handle any claims in-house? Yes/No - if yes, please provide a contact name and email address
4. Does your authority contract with a third party to manage claims? Yes/No - if yes:
a. who are they?
b. to what date are they contracted?
c. were they were procured using a competitive procurement process? Yes/No - if yes, was this an OJEU process?
5. How do you measure the effectiveness of the claims handling function?
6. Does your authority participate in shared service contractual or joint venture arrangements in respect of the management of insurance claims? Yes/No
7. Does your authority have a hybrid of the above arrangements, under which some claims are managed in one way and others in another way? Yes/No - if yes, please describe the arrangement
8. What was the value of claims against your authority’s Personal Injury insurance policies in the financial years ending March 2014 and March 2015? (Please note this is a distinct question in its own right from the Q8a below.)
a. Further and separate to Q8 above, please provide a breakdown in the last 2 years, per year:
i. Personal Injury Claims settled pre litigation and their value
ii. Personal Injury claims settled after commencement of litigation and value
iii. Value of Personal Injury claims lost

I write in regard to your Freedom of Information Act Request of 27^th June
2015.  Please refer to the information below by way of response to your
Request from Natasha Bailey of our Central Services Team.

 

 

1.            Who is your authority’s public liability insurance
provider?    Zurich Municipal

 

2.            Does your authority’s insurance provider handle claims on
your behalf? Yes

 

3.            Does your authority handle any claims in-house? No

 

4.            Does your authority contract with a third party to manage
claims? Yes - Zurich Municipal

 

b.            to what date are they contracted? 30 June 2020

 

c.             were they were procured using a competitive procurement
process? Yes. It was an OJEU process as part of the insurance contract.

 

5.            How do you  measure the effectiveness of the claims handling
function? No measures as such, Zurich have their own in-house procedures
which we rely on. Poor performance is challenged and the Council is in
constant dialogue with the providers to ensure a good service.

 

6.            Does your authority participate in shared service
contractual or joint venture arrangements in respect of the management of
insurance claims? No

 

7.            Does your authority have a hybrid of the above arrangements,
under which some claims are managed in one way and others in another way?
No

 

8.            What was the value of claims against your authority’s
Personal Injury insurance policies in the financial years ending March
2014 and March 2015?  (Please note this is a distinct question in its own
right from the Q8a below.) There was 1 claim in 2013/14 - no payments
made. There were 5 claims in 2014/15 - three remain open and the final
value is therefore currently unknown, two have been settled with no
payments made.

 

a.            Further and separate to Q8 above, please provide a breakdown
in the last 2 years, per year:

i.             Personal Injury Claims settled pre litigation and their
value - £0 in both years (see 8 above)

ii.            Personal Injury claims settled after commencement of
litigation and value -  £0 in both years (see 8 above)

iii.           Value of Personal Injury claims lost £0 in both years (see

I write further to your clarification request below.  Please refer to the
highlighted information by way of response.

 

Thank you very much for the response. With regards to your response in Q 8
- could you please advise if the  Authority has established insurance
reserves for the three claims that remain open. I would also be very
grateful if you could advise what that value is.

 

The Council does not have an established insurance reserve, the maximum
the Council would have to pay would be the excess on each claim which is
£5,000.
