2. Is OSCR currently investigating the charity, after it was hacked, personal information leaked and concerns were publicly raised about its activities? If so, when did the investigation begin? If it has concluded, please supply all correspondence relating to this investigation.

3. Has OSCR received complaints about the charity prior to June 2018? If so how many? Please could you confirm how many were upheld, and of those that were upheld, please supply copies of the related correspondence.

4. Finally, if OSCR has received any communications from other public bodies, or government ministers relating to this charity, please copies of these communications.

Freedom of Information request

 

Thank you for your email dated 11 December 2018 requesting information
from OSCR.  Your request has been considered under the Freedom of
Information (Scotland) Act 2002 (FOISA).

 

In your email you request information in respect of The Institute of
Statecraft Scottish Charity No. SC040870. In particular you asked for:

 

1. How many complaints, or completed "charity concern forms," if any, have
been received about this charity in the last six months?

 

2. Is OSCR currently investigating the charity, after it was hacked,
personal information leaked and concerns were publicly raised about its
activities? If so, when did the investigation begin? If it has concluded,
please supply all correspondence relating to this investigation. 

 

3. Has OSCR received complaints about the charity prior to June 2018? If

that were upheld, please supply copies of the related correspondence.

 

4. Finally, if OSCR has received any communications from other public
bodies, or government ministers relating to this charity, please copies of
these communications.

 

My response

 

1.    We have so far received 8 concerns about this charity including one
from an MP.

 

2.    OSCR is carrying out an investigation which is still live.  The
inquiry was started on 5^th December 2018 following notification from the
charity of the incident. As this inquiry is still ongoing no
correspondence will be released as noted in your request.

 

3.    There were no complaints prior to June 2018 and none after that date
other than those related to the current inquiry.

 

4.    A refusal under section 17 of FOISA - Notice that Information is not
held - applies to this part of the request.

 

 

Exemptions

 

In respect of point 2 you stated that if the investigation has not
concluded you do not seek the correspondence. As the case is ongoing we
are not releasing the information.  To clarify, if you had requested the
information we would apply the exemption Section 35 of FOISA – Law
Enforcement to that correspondence.

 

YOUR RIGHT TO REQUEST A REVIEW

 

You have the right to ask us to review our decision in respect of release
of information under FOISA.  Your request for review should be made within
40 working days of receipt of this letter and we will reply within 20
working days of receipt of that request.
