Under the Freedom of Information Act 2000 I am seeking the following information.

Details of any emails, correspondence and meeting minutes relating to the proposed installation of a sea going buoy as a sculpture/art installation on the station green roundabout. This should include, but not be limited to, information held relating to the decision to withdraw planning application F/TH/11/0047. This application was submitted by TDC in January 2011 has been withdrawn in November 2017.

Please also confirm if the council holds any information about a replacement scheme.

It's now 11 months since this request was submitted. If a reply is not received by close of business on Friday 12th October 2018 I will immediately raise a complaint with the ICO and ask them to investigate.

I have also included details of my other request which took 9 months and has an outstanding request for an internal review from 5 weeks ago.

Congratulations! You have reached new levels in non-compliance under the FOI act. The anniversary of the request has now passed and you are yet to reply to it.

Even when judged against your own very standards in this area, this is quite extraordinary.

Sending reminders and reporting to ICO appears to have no effect so I guess all I can do is wait for my request to reach it's second birthday and congratulate you once more.

I write further to your Freedom of Information request.

Firstly, I apologise on behalf of the Council for the delay in sending you
the requested information. This is due to a significant increase in
requests in recent months.

 

Our decision 

After a careful review of the requested information, we have decided to
redact some parts of the requested information which we consider are
exempt from disclosure by section 40 the Freedom of Information Act 2000
(the “Act”).

The requested information consisting of 115 pages is attached to this
email in two (2) batches. Please do not hesitate to contact us if you have
any difficulty in opening the information.

Reason for our decision

Section 40(2) of the Act provides that, the personal data of a 3rd party
may be withheld if its disclosure would be to someone other than the third
party; and the disclosure would contravene any of the data protection
Principles of the Data Protection Act 2018, especially the first data
protection principle that, disclosure of third party information must be
fair and lawful.

 

We consider that this third party information was provided in the
reasonable expectation that it would only be used confidentially by the
Council; and not to be published or disclosed to the whole world for any
other reason. Under the Act, we are required to consider the impact of 3rd
party disclosure in the widest possible sense.

 

On this basis, we have redacted 3rd party information from the records
requested by you.
