Dear Office for Standards in Education,

Please could you provide me with :-

1) The distribution of outcomes/results ( x% outstanding, x% good etc) of Primary school Ofsted inspections, for the most recently available 24 month period, or the most recently available 2 full reporting years. Could this information please be provided on a National basis but if a different approach is used for different areas of the country then just for England.

2) The outcomes/results of Primary school Ofsted inspections carried out by Lynne Blakelock, where she has acted as Lead Inspector, over the same 24 month / 2 year reporting period and geographic area as detailed in 1 above.

I write further to your letter dated 28th February 2013 in response to my FOI request, as detailed below –

My Request

1.The distribution of outcomes/results of primary school Ofsted inspections, for the most recently available 24 month period, or the most recent available 2 full reporting years. If a different approach is taken for different areas of the country then just for England.

2. The outcomes/results of primary school inspections carried out by Lynne Blakelock, where she has acted as a Lead Inspector, over the same 24 month/2 year reporting period and geographic area as above.

3. Copies of all notes and information recorded before and during the inspection of Keyworth Primary and Nursery School, Keyworth, Nottinghamshire on 5 and 6 February 2013.

Unfortunately, your response does not clearly explain your decision and I have a number of further queries and comments. I will deal with these using the original question order as above.

Question 1

Thank you for guiding me to your website and the pages where I can access this data. This has been very useful. There is however no data available, or none that I can find, for inspections carried our since 1st September 2012 up until now. As you confirm in your letter that you do hold this data, please could you signpost me to where I can locate it on your website or failing that, could you please provide me with the distribution of outcomes/results of primary school Ofsted Inspections since 1st September 2012 in England.

Question 2

You state that you “are not disclosing details of the outcomes of inspections carried out by Lynne Blakelock as lead inspector in the past two years as it is personal information about the inspector as an individual.”

Could you please explain to me how this can be regarded as personal data? The report is published publicly on the Internet and has the name of the Lead Inspector on it, but does not contain any information that is personal to that inspector, so how can it be regarded as personal data? This does not make sense, particularly from an organisation that is seeking to be transparent.

The report also has the name of the school, the Head teacher, the Chair of Governors, and the additional inspectors on it so following your same logic is this also personal data and if so how, therefore, can it be publicly published? If printing the name of a lead inspector on the report makes it personal data, why then are the reports not recorded as being carried out simply by “Ofsted” or anonymised?

If this data is considered personal then should you have asked for consent from all those named in the report? I assume that all the inspection team are made aware that their names are to be disclosed to others and printed on the report. I assume you ask the Head teacher and Chair of Governors that they consent for their names to be printed on the report and published publicly. Can you confirm that this is indeed the case please?

As you post copies of all reports on the internet, it is possible to use a search engine to find reports on schools for example, led or previously led by a particular Head teacher, or Chair of Governors, or to find reports on schools in a particular village or indeed Inspections carried out by a certain inspector. I am mystified as to how this data can be personal? This is not private data about an individual that I am requesting but simply names of schools.

Furthermore, the following statement in your reply confuses me –

“For example, if the data showed that an inspector awarded more settings an inadequate judgement than their peers, it may be incorrectly assumed that this is because they do not apply the evaluation schedule correctly, when, in fact, it may be entirely as a result of the way inspections were scheduled and allocated.”

This statement leads me to believe that you allocate and schedule inspections in a certain way and possibly expecting or pre-empting certain outcomes. I assumed the way inspections are allocated is in a completely random way and yet this statement implies the opposite. Are schools allocated to certain inspectors- for instance, schools judged as 2/good only given to certain Lead inspectors?

Could you please confirm how you allocate inspections? I know Serco administer this but you must have accountability for how this is done and the outcomes and you must have governance around how this activity is conducted.

Are inspectors given a guided distribution and or target distribution for Grades 1,2,3 and 4? Additionally, I was of the view that a uniform standard is applied across all school inspections and that Ofsted undertake moderation to ensure fairness. Can you confirm that this is indeed the case?

Question 3

I understand that at the time of my request the report on Keyworth Primary and Nursery school had not been published and hence any notes were unavailable. The report has now been published and I would therefore like to re-submit my request for this information, as detailed below –

Copies of all notes and information recorded before and during the inspection of Keyworth Primary and Nursery School, Keyworth, Nottinghamshire on 5 and 6 February 2013.

I note that you state the report may be subject to challenge and hence my request may be refused again. If this is the case could you please confirm how long a challenge would take to be resolved and also could you please confirm how long you keep this data. I do still wish to request under the FOI Act to see the data as described above and request guidance as to when this might be available. It would be unfortuate for all involved if the data were shredded.
