Dear Sport England,

Under FoI, please could you tell me:

- How many open positions you have for "inside IR35" workers/contractors? (ie. how many positions are you advertising but so far have not found suitable people to fill)
- How many filled "inside IR35" positions do you have? (ie. how many people are working for you with "inside IR35" conditions)

You're welcome to use any time in the recent past for these calculations, although the more recent the better, please (and please tell me what time you used). The length of tenure, either expected or worked is not important - just the number of positions is enough for me.

For example:

"On January 22nd, we had 12 open inside-IR35 positions, and 5 filled".

Yours faithfully,

Ralph Bolton

Dear Ralph

I write further to your request below for information. We have had some
difficulty responding to your request because we do not hold the
information you are seeking in the format requested. Having said that we
can provide the following information:

Sport England currently employs 283 employees as at 29 February 2020. As
employees all these individuals are subject to PAYE.

Sport England does not advertise positions as either inside or outside
IR35, and we only engage a small number of individuals through employment
agencies. The employment agency is responsible for deducting the necessary
income tax and national insurance as required.

This completes our response to your information request.

As a public body, Sport England is subject to the terms of the Freedom of
Information Act 2000 and this means you are entitled to complain if you
are unhappy with the way we have handled your information request and/or
ask us to review our decision.

If you would like to complain about the way we have handled your request
or ask for our decision to be reviewed please contact:

internal reviews within twenty working days.

If you are not content with the outcome of our Internal Review you have
the right to appeal to the Information Commissioner. Generally speaking
the Information Commissioner will not be able to consider an appeal unless
