Dear Mr Lizar

I write with reference to your recent request for information concerning
decision notices relating to complaints concerning CCTV.

Specifically your request asked for ‘the number of decision notices
there have
been regarding Open Street CCTV cameras since the DPA came into
effect.  In addition to a request for what these decisions were’.

It may be helpful to explain that when a complaint is made against a
public authority, the ICO investigates the facts behind the complaint and
may then issue a decision notice. This is the Commissioner's final view on
whether or not the public authority has complied with the Freedom of
Information Act or the Environmental Information Regulations.  

Therefore, as a decision notice will only be served as a result of a
complaint concerning breaches of the Freedom of Information Act 2000 or
Environmental Information Regulations there will be no information held
which falls within the scope of your request.

It may also be helpful to explain for future reference that all the
decision notices served are displayed on our website :

If you are dissatisfied with the response you have received and wish to
request a review of our decision or make a complaint about how your
request has been handled you should write to the Internal Compliance Team

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to the Case Reception Team, at the address below or visit the
‘Complaints’ section of our website to make a Freedom of Information
Act or Environmental Information Regulations complaint online.
