In a recent letter the Chief Constable, in describing the review proces, said,'the Force will decide if there is a 'cogent reason' not to reduce a pension. If the reason is so decided it will be forwarded to the SMP'

Thank you for your email dated 20 December 2009 in which you made a
request for access to certain information which may be held by Northumbria
Police.

As you may be aware the purpose of the Act is to allow a general right of
access to information held by a Public Authority (including the Police),
subject to certain limitations and exemptions.

You asked:

In response:

We have now had the opportunity to fully consider your request and I
provide a response for your attention.

As advised earlier in your acknowledgement this request has been
aggregated with your earlier requests, Freedom of Information Act 2000
(FOIA) request 1821/09 Police Injury Pensions, and Freedom of Information
Act 2000 (FOIA) request 1679/09 - Police Injury Pension Reviews, for
time/costing purposes as they are on the same subject area.

1. Yes, the Force still conforms to this principle. The force can
make recommendations to the SMP regarding cogent reasons based on
information provided by those subject to review however it would
ultimately be the decision of the SMP. Cogent reasons are mentioned
within Home Office circular 46/2004 which Northumbria Police also work to
when conducting reviews.

2-3. We do not hold any records of any cogent reasons that have been
accepted by either Northumbria Police or by the SMP during 2008 or 2009.
Therefore, we are unable to provide generic details of any accepted
cogent reasons.

Dear Northumbria Police,
You appear to be somewhat confused.
The letter from the CC dated 14 August 2009 states that the force will decide on cogent reasons. NOT the SMP which is quite different.If the reason is decided to be cogent by the Force then that is forwarded to the SMP ie - the Force has introduced a 'gate-keeping role' into its procedure which is against the HO 46/04 guidance.

Can you confirm.
Does the Force decide on cogent reasons and if it is so decided then passes that through to SMP - what then happens to those the Force do not agree with - does the SMP get to see these?

Dear Northumbria Police,
The Human Resources Department have a Injury Award Review Team - in July of 2009 they stated they kept all records of such reviews. From those records I want to know how many cogent reasons went through to the SMP.
