REQUEST

 

(1)As of 1st September 2017 what is the total number of former police
officers  in receipt of injury awards from West Midlands Police Authority
/ West Midlands Police Pension authority in accordance with police pension

(2)As of 1st September 2017 what is the total number of former police
officers are in receipt of injury awards from West Midlands Police
Authority / West Midlands Police Pension authority in accordance with
police pension and police injury benefit regulations in each of the 4
bands Band1 - Band4?

RESPONSE

 

Our data are not organised in such a way as to allow us to provide
information in relation to Question 2. This information is not centrally
held, although this is something that our Occupational Health team have
planned to complete in the future. At this time, to identify the band each
officer falls into, would require a manual search to locate, retrieve and
review each officer’s individual case to see which band,  that particular
officer falls into.

 

Please note that researching each individual case would exceed the
appropriate limit (FOIA, s.12 (1)).

 

Therefore, the cost of compliance with your request is above the amount to
which we are legally required to respond, i.e. the cost of locating and
retrieving the information would exceed the appropriate costs limit under
section 12 of the Freedom of information Act 2000. For West Midlands
Police, the appropriate limit is set at £450, as prescribed by the Freedom
of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004, S.I. 3244.

 

A public authority which, in relation to any request for information, is
relying on a claim that section 12 or section 14 applies must, within the
time for complying with Section 1(1), give the applicant a notice stating
that fact. In accordance with the Freedom of Information Act 2000, this
letter acts as a refusal notice.

 

However rather than refusing your request outright at this stage, I would
like to explore with you how West Midlands Police may best assist you to
request relevant information which we hold. Within the cost limit we could
the conduct the following searches

 

(1)As of 1st September 2017 what is the total number of former police
officers  in receipt of injury awards from West Midlands Police Authority
/ West Midlands Police Pension authority in accordance with police pension
and police injury benefit regulations?

 

Please note that any located information might be subject to the
application of exemptions under the Act

West Midlands Police to review its response to your request for

REQUEST

 

I wish the decision to be reviewed. As a publicly accountable body which
has pension and payroll administrators in addition to Occupational Health
I do not accept that the research will take the length of time you
estimate and that it therefore should be provided.

 

RESPONSE

 

I have reviewed the original decision and have found that to comply with
this request would exceed the appropriate limit (FOIA, s.12 (1)). As
explained in the original response (ref: 11135/17) this means that the
cost of compliance with your request is above the amount to which we are
legally required to respond. Please note in our reply we offered to
provide a response to question 1, please confirm if you require this
information?

 

Due to the different methods of recording information across 43 forces, a
specific response from one constabulary should not be seen as an
indication of what information could be supplied (within cost) by another.

Systems used for recording these figures are not generic, nor are the
procedures used locally in capturing the data. For this reason responses
between forces may differ, and should not be used for comparative
purposes.

 

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a
