On 21st June, 2021, a group of students, staff and other peoples held a protest outside the University against a letter which was sent by 15 of your lecturers, requesting you review your membership of the Stonewall Diversity Champions Scheme. At the protest, a pamphlet was handed out by a person, as yet unknown, inside which, was an incitement to violence against the 15 lecturers. Since then, the lecturers have been subjected to a campaign of threats and intimidation, leading, in one instance, to criminal damage of a lecturer's car window.

I would like to see any documents and communications pertaining to the following:

1. Communications between the Vice Chancellor and Director of Communications regarding instructions on and discussion of any investigation of the people involved in the protest and threats made against the lecturers between June 21st, 2021 and February 22nd, 2022.

2. Communications between the University and South Wales Police regarding the protest and threats made against the lecturers between June 21st, 2021 and February 22nd, 2022.

3. Did the University access the CCTV of the University premises for the purpose of identifying protestors and persons who placed stickers (with gun imagery) on the University Campus between June 21st, 2021 and February 22nd, 2022?

4. Did the University access the CCTV of the University premises for the purpose of identifying the person who smashed the lecturer's car window?

5. Any other documents and communications pertaining to the investigation of the threats and intimidation of lecturers between June 21st, 2021 and February 22nd, 2022.

6. Were any identifying details of students who were exposed by a whistleblower at the University passed onto the police during the times stated above?

7. Have there been any reprimands (of students) whatsoever, as a result of the investigation into the threats made in the Student LGBT Society Facebook group?

I first requested information form you on the 1st March, which you acknowledged with a receipt, stating you would respond "no later than 29 March 2022".

Since then, you have not only missed that original deadline, you have gone on to miss a further two deadlines, with no response beyond the third failed deadline to date.

By law, under all circumstances, you should have responded by now.

For ease of reference, I have reproduced your questions below and set out
our corresponding responses. Please once again accept our apologies for
the delay in responding to your request.

I would like to see any documents and communications pertaining to the
following:

In relation to questions 1, 6 and 7, in accordance with Section 40(5) of
the Freedom of Information Act entitled Personal Information, I can
neither confirm nor deny whether information is held in relation to your
request. The University has responsibilities under the Data Protection
legislation to ensure that the personal data it is processing is dealt
with in accordance with data protection principles. On certain matters,
particularly those where students or staff may or may not be subject to
formal procedures and in situations where these individuals’ identities
are known or suspected, to even confirm or deny the details of any
processes which have been initiated in relation to a particular
individual(s) would in itself reveal information about those individuals
which would be unfair and would be a breach of the first data protection
principle. It would not be in the reasonable expectation of students or
members of staff that such information is disclosed into the public
domain. To do so would risk damage and distress to individuals and would
damage the relationship of trust between both parties.  As such the
exemption under Section 40(5) is engaged.

 

 

2. Communications between the University and South Wales Police regarding
the protest and threats made against the lecturers between June 21st, 2021
and February 22nd, 2022.

In the interest of protecting the identity of any individual(s) who made
or were involved in complaints, we have redacted some information from the
attached emails under section 40(2) of the Freedom of Information Act
2000. Disclosure of information from which individuals concerned may be
identified would be unfair and a breach of the data protection
principles. 

 

Your request for correspondence between “the University” and South Wales
Police is extremely broad and so in order to provide you with some
information we have limited our search to key colleagues and departments
who we understand would be likely to hold the information requested. We
have therefore provided the information we have been able to locate within
the parameters of our search. To expand the search further would mean the
time involved in searching for and providing the information you have
requested would exceed the time limit (18 hours) allowed under the Freedom
of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004.  Accordingly section 12(2) of the Freedom of Information
Act 2000 will apply.  

 

 

3. Did the University access the CCTV of the University premises for the
purpose of identifying protestors and persons who placed stickers (with
gun imagery) on the University Campus between June 21st, 2021 and February
22nd, 2022?

Yes, CCTV was accessed in November 2021.

 

4. Did the University access the CCTV of the University premises for the
purpose of identifying the person who smashed the lecturer's car window?

Yes.

 

5. Any other documents and communications pertaining to the investigation
of the threats and intimidation of lecturers between June 21st, 2021 and
February 22nd, 2022.

The time involved in searching for and providing the information you have
requested would exceed the time limit (18 hours) allowed under the Freedom
of Information and Data Protection (Appropriate Limit and Fees)
Regulations 2004.  Accordingly section 12(2) of the Freedom of Information
Act 2000 will apply.

I am writing to request an internal review of Cardiff University's handling of my FOI request 'Information/communications about the (Stonewall letter) protest on the 21st June 2021, the resulting threats to staff & any subsequent investigation.'.

Please review this decision, as I believe the exemption has been applied wrongly. Note that I am not requesting personal information.

You claimed in question 1, that any processes revealed about those issues would reveal information about certain individuals and therefore a breach of the first data protection principle I do not agree. I did not ask for any personal information. I asked for, "communications regarding instructions on and discussion of any investigation of the people" involved, not the people themselves, or their names.

You also claimed the same (breach of the first data protection principle) for question 6 & 7. Again, I did not request any personal information. For question 6, I asked if details had been passed onto the police. A simple yes or no would have sufficed.

Same for question 7, in which I asked, "have there been any reprimands...as a result of the investigation. Again, a simple yes or no would have sufficed, without any need for personal information.
