I am writing to request an internal review of North Yorkshire Police, Fire and Crime Commissioner's handling of my FOI request 'Information Rights Appeal EA/2017/0107'.

The PFCC is in breach of section 10 and 17 of the Act. Please provide an explanation.

The PFCC is, also, arguably, in breach of Section 77 of the Act. Please provide reasons why a complaint should not be made by way of s77 regarding the deliberate concealing of information.

The PFCC, it is submitted, is continuing her persistent, long-running campaign to vex, annoy and harass a journalist, following his vocation, and mis-using the Act for that purpose.

I am writing to request a second internal review of North Yorkshire Police, Fire and Crime Commissioner's handling of my FOI request 'Information Rights Appeal EA/2017/0107'.

The grounds for complaint are:

1. Section 10 and 17 of the Act were both breached. No explanation has been provided, other than a claim, completely absent of evidence, that 'the Civil Disclosure Unit has a high workload'.

2. Parliament did not intend for the Police and Crime Commissioner for North Yorkshire to treat it with absolute contempt when drafting the Act. If there is a 'high workload' then she has a legal duty to provide the appropriate resources.

3. My submission regarding the delay, made with some force and with ample evidence, is that the delay is a continuation of the long running campaign of harassment by the PCC against this applicant.

4. Section 77 of the Act may also be engaged. It is my submission that information is being deliberately withheld and false exemptions applied.

5. Given the page count of the hearing bundle, the length of the skeleton argument and final submissions drafted by counsel, together with other attendance on client and a return trip from London to Wakefield, the information provided cannot be accurate for a barrister with 9 years call and a thriving practice.

6. The reliance on section 40 (5) is both misconceived and mischievous. Disclosure of two sums of money (Q's 2 and3) connected to an unnamed individual does not amount to personal information. NYPCC lost an Information Rights Tribunal case EA/2017/076 on a similar ground.

7. It is inconceivable in any well run organisation that a solicitor records his or her time on a particular matter. More particularly, when he or she is publicly funded and a Head of Department. A lack of such accountability would be genuinely alarming. Accordingly, it is not accepted that there is no information held at Q4.

On 20th September, 2019 I made a request for information concerning the role of Sarah Saunders within the Civil Disclosure Unit. Your are in breach of Section 10 and Section 17 of the Act by failing to disclose the information, or relying on an exemption not to disclose. It is my respectful submission that Section 77 may also be engaged.

On a wider view, these latest breaches of the Act, amongst a depressingly long list of previous breaches, go to the long running campaign of harassment pursued by the Police Commissioner against an accredited journalist pursuing his vocation.

4. All rights of civil remedy, including an Application to the Director of Public Prosecutions to privately prosecute the PCC under section 77 of the Act, and, quite separately, a misfeasance claim, are reserved.

Rights Appeal EA/2017/0107

Dear North Yorkshire Police, Fire and Crime Commissioner,

I am writing to request an internal review of North Yorkshire Police, Fire
and Crime Commissioner's handling of my FOI request 'Information Rights
Appeal EA/2017/0107'.

1. The section 14 exemption has been misapplied. The reasoning given is
false and mendacious.

2. Section 77 is engaged as the refusal to disclose the information
requested is deliberate, calculating and is designed only to conceal
tortious civil breaches and/or solicitor regulatory breaches and/or
criminal offences.

3. The refusal to disclose is part of a long-running and wider campaign by
the Police and Crime Commissioner (PCC) to vex, annoy and harass the
applicant - a journalist routinely pursuing his vocation.

4. All rights of civil remedy, including an Application to the Director of
Public Prosecutions to privately prosecute the PCC under section 77 of the
Act, and, quite separately, a misfeasance claim, are reserved.

Dear Civil Disclosure,

The Police and Crime Commissioner was instructed on 30th September, 2020, by the Information Commissioner's Office, to provide an internal review response.

For the benefit of What Do They Know readers and fellow users, no such response was received. I will be storifying this request and publishing it. At the same time, urging the ICO to institute criminal proceedings against Julia Mulligan.
