The University has considered your request and is unable to provide a full
response for the following reasons:

 

1.     Some of the information you have asked for (FOI request compliance
data) is routinely published by the University on our website on a
quarterly basis, in accordance with the current Government Freedom of
Information Code of Practice.  It is therefore exempt from disclosure
under s21 and 22 of the Freedom of Information Act 2000.  These exemptions
relate to information which is already accessible / published by the
University and information which is due to be published in future.  You

2.     Not all of the information is recorded, calculated or broken down
in the way you have requested, and an attempt to identify and retrieve all
of the requested data would be likely to exceed the cost limit under the
Appropriate Limits & Fees Regulations.  The cost limit is set at £450/18
hours.  The information you have requested is therefore exempt from
disclosure under s12 of the Freedom of Information Act 2000.  The reasons
for this are set out below:

 

-        Some of the data has not been recorded/monitored in the way you
have specified, for example, for data subject access requests we do not
centrally record the outcomes that you have specified in question 4; we
would need to inspect the contents of each case file to determine this.

-        Some of the data has not been retained long term: for example, we
no longer hold data subject access request logs or case files for 2017 or
earlier, in accordance with our records retention schedule.

-        There have been significant changes in the resourcing & structure
of information governance management within the University; and also
significant changes in the legislation (ie the introduction of the GDPR
and the Data Protection Act 2018) during the period you have specified. 
This led to a number of changes in the way information compliance data has
been processed and recorded during this time; and the information you are
seeking has not, therefore, been consistently recorded in the way you have
specified throughout the specified periods of time, there are gaps and
differences in the information recorded as this varied according to
need/priority at that time. 

 

The only way to be able to provide complete or accurate data for previous
years would be to manually check through the individual case files for
each request and calculate the information to report to you.  As there are
approximately 745 case files which are potentially relevant to your
request, this would be likely to exceed the cost limit for complying with
a request under s12 of the Act.

 

However, in order to assist you, we can provide the following information:

 

FOI requests:

For 2019, as advised above, FOI compliance statistics are now regularly

2018: a total of 311 FOI requests were received

2017: a total of 283 FOI requests were received

 

Data subject rights requests:

2019: 30 files are held

2018: 60 files are held

 

Central management of Information Rights requests:

With regard to the University’s response to FOI requests and Data Subjects
Rights requests, management of information rights requests sits within the
newly formed Information Governance function within Legal Services.  We
are unable to provide an FTE relating specifically to FOI requests and
data subjects rights, however, as this information is not held/recorded by
the University: all staff within the Information Governance team have
wider information governance responsibilities, no individual deals
exclusively with information requests.  However, if helpful, we can advise
that the team currently consists of one Data Protection Officer, two
Senior Information Governance Officers, one Records Manager, and an
Information Governance Assistant.

 

If you are dissatisfied with this response and wish to appeal our

appealing.  You must appeal within 2 months of the date of this email. 
Under s5.3 of the Freedom of Information Act Code of Practice, we are not
