Act”), for the following information:

 

“I am looking to acquire a Excel datasheet CSV/XLS Excel list of all
Financial Services organisations in England, N Ireland and Scotland
regulated by the FCA, ideally providing Procurement or Estates Management
names, address, email address, website and telephones numbers contact
details, but not essential if prohibitive.”

 

Your request has now been considered.

 

We can confirm that we do not hold contact details for the person
responsible for “Procurement or Estates Management” at each financial
services firm.

 

In respect of the remainder of the information you have requested, this
information is available via the FCA’s Register Extract Service (RES)
which forms part of our Publication Scheme and contains details of how you
can buy data or subscribe, for a fee, if you wish to receive an extract.

 

Therefore, to the extent that the FCA holds information reasonably
accessible to you in other ways, in this case via our Register Extract
Service Team, we are not required under the Act to release it to you as
the absolute exemption under section 21 (Information reasonably accessible
to the applicant by other means) applies.  Please see Annex A below for a
detailed explanation of why this exemption applies.

Annex A

·             Section 21 (Information reasonably accessible to the
applicant by other means)

 

To the extent that we do hold publicly available information, we are not
required to release this under the section 21 exemption as it is
information which is accessible to you by other means.

 

In terms of section 21, sub-section (3) states that where an authority is
not obliged to publish information, that information is not to be regarded
as reasonably accessible to the applicant merely because the information
is available from the public authority itself on request
([2]http://www.legislation.gov.uk/ukpga/2000... However,
this is subject to the following proviso, “unless the information is made
available in accordance with the authority’s publication scheme and any
payment is specified in, or determined in accordance with the scheme”.

 

The Information Commissioner’s Office (ICO), which oversees and enforces
the Act, requires authorities such as the FCA to produce a guide to the
specific information held, and which is contained within seven high-level
categories, under a Publication Scheme.  In this instance the requested
information is made available via the Financial Services Register and this
public record is listed on the [3]FCA Publication Scheme.  An asterisk
indicates that there may be a charge for information.

 

The ICO has also published Guidance on this subject which indicates that
information which is available under the terms of a Publication Scheme is
to be regarded as reasonably accessible.  See page 12 onwards [4]here.
