I write regarding your requests,
FOI.22.SEL050 NHS South East London ICB
which are being processed under the Freedom of Information Act 2000.
It is with sincere apologies that in line with current Freedom of Information Act legislation the ICB feels that it must conduct a public interest test as to whether to apply a ‘qualified’ exemption for commercially sensitive information as detailed in section 36 of the Act.
We have, as required, applied a prejudice test to determine whether the release of the information would, or would be likely to, harm someone’s commercial interests.
We will now consider the necessary public interest element to weigh up the prejudice which may be caused by disclosure against the likely benefit to the wider public and detail the outcome of this review in our final response to your request.
The Act makes specific procedural provision for the handling of cases which require an assessment of the balance of the public interest to be made. Under section 10(1) of the Act, there is a general time limit of 20 working days for making a response to a request for information. However, section 10(3) permits a public authority to take an additional, though ‘reasonable’, period of time to reach its final decision in those cases where a ‘qualified’ exemption is engaged and the balance of the public interest must be assessed. The ICB has set a new deadline for the final response to your request which is 17 August 2022.
