Please supply all the information generated by the above people’s complaints to the police, the RSPB and any other organisation that you may hold. This includes emails, letters, phone calls and minutes taken at any meetings in relation to our complaints. We do not need copies of the letters supplied by the above people making their complaints as we just want the information generated by the letters of complaints.
As a footnote the above people have been greatly shocked at suggestions by the police that they are being less than truthful about a certain person. Given this fact all the communications that you hold in relation to the police and any other body claiming that what we have to say is not the truth we want disclosed so we can explain what is really true so the police can be better informed. This disclosure must be supplied quickly in the public interest to allow the police to full fill their duty of care and to comply with the law.

Thank you for your request dated 3rd August 2010, the contents of which
have been noted.

The information you have requested (if held) is classed as personal
information, it is therefore exempt from disclosure under the Freedom of
Information Act 2000. We shall therefore not consider this request under
the Freedom of Information Act 2000 as no response could be released into
the public domain by the Force.

In order to obtain copies of information held about you, a subject access
request should be submitted along with a copy of proof of identity and the
appropriate fee of ten pounds. Further information and the appropriate
forms that can be used are available on the Northumbria Police web-site
(www.northumbria.police.uk).

Should Mr Robb, Mr Dodsworth and Mr Street require similar information (if
held) regarding them, they too can submit subject access requests to the
Northumbria Police Headquarters address which is given both on the

Dear Mr Canning

I write further to my letter of 14 June 2010 concerning your complaint about the processing of your personal information by Northumbria Police (NP). As I have already explained, our duty in relation to your complaint is to make an assessment. An assessment is a view or opinion about whether it is likely or unlikely that NP complied with the principles of the Data Protection Act 1998 (the DPA) in the situation that you described to us.

You were concerned about the way that NP handled your information requests.

On 17 May 2009 you wrote:
‘Please supply all of the information in relation to Northumberland Police, the RSPB and Animal Health stating to the aforesaid not to use Nottingham University single locus probes in my court case.’’
On 4 July 2009 you wrote:
‘Please supply all the information that you hold on the items and birds seized by the courts in my case and if the items were sold for the public purse or was my property given away to the RSPB or the Police and helpers of the police/RSPB.’

It was the ICO’s view that these were requests for your personal information and should therefore have been treated as subject access requests under the DPA.

The sixth principle says that personal information shall be processed in accordance with the rights of data subjects under the DPA. One of these is the right of access to personal information.

From the information you provided I was not able to make my assessment. I asked NP for their views and they have now provided the information I requested.

NP has now explained that because the requests were made via Whatdotheyknow.com website they did not recognise these requests as subject access requests and treated them as FOI requests. NP has indicated that, should you still wish to request the information referred to above, you will need to complete their subject access form and provide them with a £10 fee and proof of identity. When they receive this information they will process your subject access request in line with the legislation. NP has provided a copy of their subject access request form to assist you and I have enclosed a copy with this letter.

I should, however, point out that Section 8(3) of the DPA says that

‘Where a data controller has previously complied with a request made under section 7 by an individual, the data controller is not obliged to comply with a subsequent identical or similar request under that section by that individual unless a reasonable interval has elapsed between compliance with the previous request and the making of the current request.’

I should also make it clear that the subject access right is not an absolute one and there are exemptions that mean data controllers can legitimately withhold information in certain circumstances.

From all of the information that is now available to me it appears that NP has failed to comply with the sixth principle in this case because they did not recognise your request as being for your personal data.

In light of this it is my assessment that it is unlikely that NP has complied with the DPA in this case.

I will now write to NP to tell them about this assessment and recommend that in future they consider information requests under both Acts and respond under the appropriate legislation.

This matter is now closed. Thank you for bringing it to our attention.
