I should like to request the following information. I should prefer to receive these in electronic format at this email address.

- Any papers that ORR submitted to the Thameslink 2018 Industry Readiness Board for its meetings from January 2017 to present
- ORR's internal memos covering pre-meeting and post-meeting input/outcomes from the Thameslink 2018 Industry Readiness Board for its meetings from January 2017 to present

I understand that the names/personal information of junior stay may be redacted, as might commercially and operationally sensitive information.

In considering the extent of your redactions and compliance with this request, I would appreciate it if you consider a) that commercially and operationally sensitive information may become less sensitive over time; b) the level of public interest in this information given the serious and ongoing disruption that has arisen from the introduction of the May 2018 timetable.

As you will be aware, the public interest test should be applied to non-absolute exemptions, and that the s(2) 43 exemption regarding commercial interests is one to which public interest test must be applied.

I write further to my email of 7^th June and your request for information
regarding the Thameslink 2018  Readiness Board.

 

I am handling your request under the terms of the Freedom of Information
Act 2000 (FoIA 2000) and can confirm we do hold some information relevant
to your request.

 

Although FoIA 2000 normally requires us to send a response within 20
working days, it is sometimes necessary to extend this limit in certain
circumstances, especially if a qualified exemption is being considered.

 

In this case we will need to extend the response deadline, because the
information you have asked for needs to be considered under an FoIA
exemption where a public interest test applies. This means that we need to
assess whether the public interest in disclosing the information outweighs
the public interest in withholding it, and extra time can be allowed for
this deliberation.

 

The exemption which we are considering is:

 

o s.22 (1) (a) - information intended for future publication.

 

I also consider that s.40 (2) (b) – personal information, is also relevant
to some parts of the information

 

I will write again no later than the 1^st August with the outcome of my
deliberations.

I write further to my email of 5^th July regarding the Thameslink 2018
Readiness Board and thank you for your reply of 6^th July.

 

As previously mentioned, I consider that the information we hold relating
to your request is covered by the following FoIA exemptions:

 

o s.22 (1) (a) - information intended for future publication.
o s.40 (2) (b) - personal information.

 

Under FoIA 2000, there are two types of exemptions, absolute and
qualified. The s.22 exemption is a qualified exemption subject to the
public interest test, which means considering the factors in favour of
disclosure balanced against the factors for maintaining the exemption. The
personal information exemption (s.40) is an absolute exemption not subject
to the public interest test.

 

In this case I have considered the following factors in favour of
disclosure:

 

o Promote transparency in ORR’s processes and work.

 

Balanced against the following factors for maintaining the exemption.

 

o Early disclosure of information that is currently being prepared for
publication (minutes, associated documents etc.)  would be misleading
and lead to possibly incorrect interpretation. This would  be
detrimental to ORR and other departments and organisations in how we
publish reports and similar information in the future.

 

Decision

 

After careful consideration of the above factors I believe the public
interest is best served by maintaining the exemption. I understand that
the Department for Transport (DfT) will be publishing  the information
relevant to your request very shortly (this month), this includes the
information ORR holds for the Thameslink 2018 Readiness Board and the
minutes of the Independent Assurance Panel. I will forward you the link to
the information once it is published.
