FREEDOM OF INFORMATION REQUEST
Thank you for your e-mail of 14^th July 2024, requesting information from
the Planning Inspectorate under the Freedom of Information Act, this has
been passed to me to respond as your appeal fell within my regional area.
You have made the following request:
“Please share all internal and external communication from the appeal
(excluding anything already shared during the natural course of the appeal
with the appellant).”
I would highlight the transparent and openness of the appeal process. In
order to ensure transparency all information and documentation placed
before the Inspector in
an appeal is in the public domain. Both the Council and your Agent
representative are cross copied evidence and correspondence so that there
is awareness of what is being
presented. Accordingly, the parties will be in possession of all the
information that was before the Inspector in determining the appeal.
I have reviewed the case and the submission and in this case there were 3
things outside the normal procedure.
• the LPA did not send the questionnaire when expected, the case
officer sent an email chasing Email 1.
• The Inspector requested some policy documents that were not supplied
Email 2
• Certain documents were not published on the on the LPA website in time
so the date for comments had to be extended, however the case officer
sent your agent an email with copies of exchanges regarding this but I
copy again for information Email 3.

I presume you're going to respond the the rest of this request at a later date, but want to clarify something about your initial response.
1 - can you clarify which attachments you mean when you refer to Email1, Email2 and Email3 as I can't see anything in their naming that directs me to this.
2 - When you say certain documents weren't published by the LPA, can you be more which documents weren't published?
3 - All Email header information has been removed from the emails attached that would have shown chronology, can you attached the full header, accepting that some email addresses might need partially redacting of course?

Good Morning Mr McGovern, your request was sent to me as -

Was there another part to your request?
I have checked the records and the only things that were not already sent to you via your agent of course were the 3 emails that I attached with my response. I named them email 1, 2 and 3 for ease.
Email 1 - this is a copy of an email sent from the case officer to the LPA asking them to send the questionnaire.
Email 2 - this is a copy of the email sent to the LPA requesting policies that should have been sent, but were not so we had to request them.
Email 3 - This was a copy of the email sent to your agent which included the email exchanges with the LPA concerning the failure to publish the appeal document on their web site at the expected time to allow anyone if they wish the time to comment.
When the email left me the attachments were numbered Email 1, 2 and 3. There are exact copies of the emails that the case officer sent including the header. I do not need to redact as its sharing things that were sent to the LPA and their email address and that of the Inspectorate do not need it, I am sorry of the attachment name reverted back to its original email name.
I will forward them on 1 by one under separate emails now so you can see exactly what they were.

Mr McGovern, this email is in relation to the things that were not
published and lead to the extra time to comment. The LPA have to publish
the appeal documents, your statement and appendixes and interested parties
have to be able to comment.
The LPA didn’t publish it all, this email exchange results in them

I wonder if you can get back to me re the delay in putting the Appeal
Heritage Statement and the Appendices listed in the Grounds of Appeal
Statement onto the Council's Planning Website.
The appeal Heritage Statement appeared today 13th February, and not on the
31st January which the website states. I know this to be the case as I
have checked every day since 31st January, and I would not have emailed
you and the Council's planning case officer, Angela Wrigley, on Friday 9th
February, if the Heritage Statement had already been uploaded. I also
spoke to Angela Wrigley yesterday afternoon, and she said she would check
what had happened in terms of the uploading.
I appendices have still not been uploaded.
In the light of the above, it would be appreciated if you could allow some
additional time for representations to be made. As a matter of fact the
Heritage Statement is over 70 pages long.

Thank you for your request of 14 July 2024 for information from the Planning Inspectorate. Your request has been considered under the Freedom of Information Act 2000 (FOIA).
Your request is:
1. Please share all internal and external communication from the appeal (excluding anything already shared during the natural course of the appeal with the appellant).
2 - Please share the Inspector’s visit notes and photos from the site visit. 3 - What date and time was the site visit?
4 - Where did the Inspector park her car for the visit? 5 - Was the Inspector approached by anyone during her visit? 6 - Did the Inspector enter the plot and walk around the entire boundary, crossing the bridge to access the rear of Top Road part of the plot? 7 - Did the Inspector walk any of the several public footpaths that link the plot with the village facilities and core? 8 - Does the Inspector know or have worked with Peter Yates (the primary objector) at any point in her career? “
9. What specific qualifications related to heritage and conservation areas does the Inspector have and when were these attained? The Freedom of Information Act gives rights of public access to information held by public authorities. The right of access only applies to recorded information. Accordingly, not all points of your request are interpreted as valid under the Freedom of Information Act. A number of points of request are for clarification of certain matters, rather than for recorded information; these are also covered below.
In response;

The site visit notes and photos are attached. Please be aware that these notes and photographs are taken solely as an aide-mémoire for the Inspector and have no official status. You will note that some personal information has been redacted from the photographs. The minimal information is third party personal data, the disclosure of which is likely to breach the first data protection principle, being neither fair nor justified by any conditions in schedule 2 of the Data Protection Act.

The site visit was held on 10 April 2024 at around 11.30am. The Inspector walked around the area and also drove around the village. The Inspector left the area at around 12.30.

The Inspector parked in Top Lane, near to no. 40.

The Inspector was not approached by anyone. Some people were apparent, for example, in the grounds of a property and the Inspector saw a dogwalker on the public footpath along the side of the site.

The Inspector did not enter the plot. This was an unaccompanied/no access required site visit. The appeal form stated that the site was visible from public land. The Council had also indicated at Part 1 (Questions 2a and 2b) that the relevant part of the appeal site can be seen from a road, public footpath, bridleway or other public land and it is not essential for the Inspector to enter the site to assess the impact of the proposal. The Inspector viewed the site from public vantage points, including the adjacent public footpath and Dark Lane. The Inspector saw the small bridge across the stream leading to the rear gardens of properties in Top Lane but this was fenced/gated. The Inspector was able to see what they needed to at the site visit.

The Inspector did walk some of the public footpaths and walked down Dark Lane to end of Road/Brookside. The Inspector walked back round to Top Lane, to the car, and drove around village. They noted footpath links to playing fields and beyond but did not walk them.

The Inspector does not know Peter Yates and does not recall him either now or previously. Inspectors do encounter planning professionals in the course of their careers. The principles of fairness, impartiality and openness are important and our code of conduct and conflict of interest policy are available at The Planning Inspectorate Code of Conduct - GOV.UK (www.gov.uk). Inspectors very much have the code of conduct and conflict of interest policy in mind in casework at all times and will raise any possible potential or perceived conflict of interest. There was no reason for the Inspector not to deal with this appeal.

Regarding qualifications, this is personal information and Section 40(2) of the Freedom of Information Act 2000 (FOIA) provides an absolute exemption for personal data where it breaches any of the principles in the Data Protection Act (DPA). There will be a reasonable expectation amongst Inspectors that we do not make such personal information publicly available (with regard to qualifications, no more that they are prepared to disclose on their decision letters). As such, disclosure would breach the first data protection principle as being neither fair,
lawful, or transparent. It
is not considered proportionate in relation to any legitimate wider public interest. I am afraid we must apply section 40(2) of the FOIA and refuse this request.

To summarise:
The inspector spent less than an hour total in Kingsley, parked 10 minutes walk away from the site, didn't enter the site despite the gates all being open, didn't see the BNG area proposed, didn't walk any of the footpaths that lead to the village facilities, made a highly subjective statement about it being an "uninviting walk even in the daylight". Add this to the visit notes, that contain many positive notes about street scene that don't make it through to the decision and several basic mistakes such as "removing hedge will make property very prominent" (it's clear in the plan that the hedge was being replaced and enhanced) and "bungalow" (the properties on Top Road are either already 2 story (54 Top Road) or there are approved plans for 2 x 2 story dwellings (52 Top Road) which are repeated in the appeal decision.
On point 8 It's quite possible that the Inspector has forgotten her and Mr Yates worked together in Cheshire East in the early part of her career in neighbouring boroughs that shared many resources, but as you say, planning is a relatively small world so this isn't surprising.
On point 9 I'd like to state there is a public interest when an Inspector overrules 2 qualified conservation experts (one acting on behalf of the LPA) without stating any evidence that may have led her to take that stance. We've checked all relevant governing bodies and it's clear the Inspector has no qualifications relevant to make Conservation judgement as she did in this case. I'd say that is a worrying lack of professionalism on behalf of the Inspectorate and suggest their standards team should be taking a look at how these kind of subjective and unsubstantiated aspects of decisions undermine the overall planning system in the UK.
