I refer to your Freedom of Information request dated the 26^th July, 2016.

 

Please find below the Authority’s response to your request:-

 

Question:- 

 

“Please provide details of any negotiations or planned negotiations
regarding the sale, transfer, or relinquishing in any other manner of land
at Newry Beach, Holyhead under Land Registry Title number CYM466280,
Ordnance Survey map reference SH2483SW.”

 

Reply:-

 

The information requested is exempt by virtue of Section 43(2) of the
Freedom of Information Act 2000 as its disclosure would or would be likely
to prejudice the commercial  interest of any person (including the public
authority holding it).

 

This exemption is subject to the public interest test and I note below my
reasoning for maintaining the exemption.

It is my belief that releasing details of the negotiations could indicate
to current, and potential future contacts baseline information that could
be used for any future negotiations, providing them with a bargaining tool
which would undermine the authority’s ability to maintain an even handed
negotiating position and prevent it fulfilling its Best Value duty under
the Local Government Act 1999.

 

Having considered the public interest both for and against disclosure of
the information you have requested, I have concluded that the overall
public interest lies in maintaining the exemptions outlined above and
non-disclosure of the information.

If you are dissatisfied with any aspect of this response to your request
for information, and / or the decision made to withhold information, you
may ask for an internal review.  Please address your correspondence to the
