Information regarding counter fraud actitivites

We're waiting for S Alexander to read recent responses and update the status.

Dear NHS England,

Can you please provide the following information under FOI

1. Please confirm the provider of your outsourced counter fraud services

2. Please confirm the number of staff who are employeed to perform counter fraud activities and their job titles (LCFS etc.) and the working time equivalent spent on counter fraud activities

3. Can you please confirm if the contractor can use the NHS Powers Act 2006

4. Can the outsourced counter fraud organisation obtain information using Memorandums of Understanding and information sharing agreements set up between NHS Protect and various organisations as part of their duties or are they required to go via NHS protect for information.

5. Please give the following statistics for years 2000-2015
How many referrals did the outsourced counter fraud services receive?
How many referrals were classified as No Further Action?
How many cases resulted in disciplinary sanctions?
How many cases resulted in civil sanctions?
How many cases resulted in criminal sanctions?
How many cases in total went to court each year?

NHS England holds some information relevant to your request. Our answers
have been numbered for your convenience.

 

1. Deloitte LLP are contracted by NHS England to provide the services of
Accredited Counter Fraud Specialists.  They have held this contract since
June 2013. 

 

2. In addition to the outsourced function described in the answer to
question 1, NHS England currently employs a full time (1.0 Whole Time
Equivalent) Counter Fraud Lead. 

 

3. Please note that the FOI Act gives you the right to ask any public
sector organisation for the recorded information they have on any subject.
The authority does not have to answer your question if this would mean
creating new information or giving an opinion or judgment that is not
already recorded. The question you have asked is a matter of legal
interpretation and therefore we do not hold information relevant to this
question

 

4. NHS Protect have published numerous Memorandums of Understanding on
their website [1]http://www.nhsbsa.nhs.uk/3522.aspx 

 

5. It may help if I explain that, as NHS England only came into being in
its current form since 1 April 2013, NHS England does not have this
information for the period requested.  NHS Protect leads the NHS in its
approach to tackling crime.  NHS Protect may be able to assist with the
statistics for previous organisations.

 

Deloitte have received 507 referrals to date, all of which were considered
for investigation.  We currently have 90 ongoing investigations.

 

Investigations can involve a number of agencies. To date there have been
eight criminal sanctions recorded where Deloitte have contributed to, or
have been undertaken as a result of investigations conducted by Deloitte. 
These are split across the financial years as follows:

 

o 1 in 2014/2015
o 4 in 2015/2016
o 3 in 2016/2017 to date.

 

In addition to these criminal sanctions there have also been 6 internal
disciplinary sanctions and 31 referrals to professional bodies, such as
the General Medical Council (GMC), General Pharmaceutical Council (GPhC),
or General Dental Council (GDC) for consideration.  There have been 24
investigations where financial recoveries have been identified and have
been received or pending. 

 

It should be noted that this is only part of the anti-fraud response to
protect NHS England’s funds.  The NHS Protect National Investigation
Service is responsible for the investigation of the most serious and
complex cases of fraud, bribery and corruption across the entire NHS. 
Investigations are tasked to NHS Protect to undertake, rather than to NHS
England or individual NHS Trusts, where intelligence indicates that the
matters reported meet the criteria of serious and complex economic crime
matters.
