Information re pensions, payments and benefits - including temp/interim staff/consultants for KCC and its associated trading vehicles/entities

We're waiting for Nathaniel Waite to read a recent response and update the status.

Dear Kent County Council,

For the 12 month period between 1 April to 31 March for the years:
2013/14,
2014/15,
2015/16,
2016/17, I would like the following information:

1. The total number of employees on the Kent County Council payroll system who, as part of their pay, received a contribution to the Kent County Council pension scheme
2 The total number of full-time employees working for companies or trading vehicles in which Kent County Council has a financial/legal/governance interest (please show figures for each of the operations (eg Legal Services, Edukent etc)
3 For each of the companies or trading vehicles, the number of consultants/interims/contractors/temporary staff
4 For each of the companies or trading vehicles, the total number of hours worked by each consultant/interim/contractor/
temporary staff (if the consultant/interim/contractor/
temporary staff was employed on a daily/weekly/ rate, please give the daily rate and the number of hours the person was contracted to work each day/week)
5 For each of the companies or trading vehicles, the total amount that was paid to each consultant/interim/contractor/
temporary staff (if the consultant/interim/contractor/
temporary staff was employed on a daily/weekly/ rate, please give the daily rate and the number of hours the person was contracted to work each day/week)

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Information re pensions, payments and benefits - including temp/interim staff/consultants for KCC and its associated trading vehicles/entities'.

I would ask for an internal review along these lines:

I do not believe your 'non payroll staffing' response is sufficient Many of these individuals are earning over £50k (indeed one appears to have earned around £250k) and they are therefore subject to the Local Government Transparency Code 2015 governing the legitimate public interest in the scrutiny of senior individuals and decision makers. The code states that information for individuals earning over £50k should include their job title and list their responsibilities and functions and number of staff. Information for senior individuals earning £150k or more should include their name.

Furthermore, you say that 'role descriptions have been categorised to protect individuals identity from identification by job description'. I do not see any reason to protect the identity pf the individuals who earned over £50k as the Code says that there should be a clause in their contracts allowing for the disclosure of such information. Why should non-payroll staff be subject to different rules from payroll staff when they are all performing a public service?

Thank you for your email of 11th May 2018. Please accept my apologies for
the delay in acknowledging receipt.

I am sorry you are unhappy with KCC's response to your request for
information, in particular the fact that we have not provided information
about non-payroll staff earning in excess of £50,000 per annum. 

An independent officer who was not involved with your original request
will investigate your complaint and review our original response on behalf
of the Head of Paid Service. Their reply will be forthcoming within 20
working days from receipt (by 11th June 2018)

I am writing to request an internal review of Kent County Council's handling of my FOI request 'Information re pensions, payments and benefits - including temp/interim staff/consultants for KCC and its associated trading vehicles/entities'.

I would like to complain about the response I received by Kent County Council to this FOI request.

In your guidance on publication schemes, you say that salary and benefit details of employees earning over £58,200 should be published by public organisations. Although you do not say whether such employees are temporary or permanent, it stands to reason that if the cumulative annual payment to anyone who is paid by a public authority is over the £58,200 threshold, this should be transparent.

In its response to my request, Kent County Council have refused to reveal the job roles for their temporary staff and have, instead categorised them "to protect individuals identity from identification by job title" and yet it appears that some of these individuals are earning over £200k and they have been employed for longer than might be expected for a temporary role.

This is, therefore, not transparent. In fact, for the people who have received over £58,200 pa, I believe their names should also be provided as well as the roles.

Thank you for your email.

 

It would appear that you are asking for a further internal review,
however, your next course of action if you are not satisfied with the
outcome of the internal review already carried out (see attached), should
be to escalate the matter to the ICO The outcome of this review was that
KCC does not hold information in relation to temps/consultants/interims
for Gen2 and other trading companies (which is what your original request
and complaint related to) and that you should direct your request for this
information directly to the trading companies.

 

I note that your latest email refers to KCC not revealing information
about its own temporary staff, however, in your original request you were
seeking information about temps/contractors/interims for KCC's companies
or trading vehicles, not KCC itself.

 

For your information, KCC does publish details of all staff paid directly
by KCC (so this includes interim and temporary staff but excludes agency
staff) earning over £50,000 and although the Local Government Transparency
Code only requires us to publish names of staff earning in excess of
£150,000, we do in fact publish the names, grades and salaries of all
senior management regardless.
