I am requesting the following information under the Freedom of Information Act. Please could you send me:

- All the correspondence that has taken place between Dogs4Us and the council
- All the records held on Dogs4Us, including inspection sheets
- All the reports held on Dogs4Us (most importantly your most recent licence inspection report and the number of puppies sold with inherited defects).
- Confirmation that all inspections are completely unannounced (ie. neither the date nor the time are told or the week in which the inspection will take place.)
- Proof of the fact that Dogs4Us no longer trade with breeder Eric Hale
- Any information that the council holds about any agent supplying to the store
- Any information that the council holds about any breeder supplying to the store
- Any other data held about Dogs4Us

Dear Salford City Council,

I am writing to request an internal review of Salford City Council's handling of my FOI request 'Information re Dogs4Us'.

The response was inadequate as the following information was not sent:

- The number of puppies sold with inherited defects.
- I asked for all the reports held on Dogs4Us however I see you no record of the investigation that you mentioned following the Panorama expose. (Please see your letter in response to this FOI request: “...following an investigation due to a Panorama programme.”)

Furthermore the information below was improperly excluded from disclosure:

- Any information that the council holds about any agent supplying to the store.
- Any information that the council holds about any breeder supplying to the store.

While it is correct that the first Data Protection principle requires that personal data are processed fairly and lawfully, disclosure in this case meets this requirement.

A licensed dog breeder/agent has an expectation that the fact they hold a licence to breed and sell dogs will be disclosed to the public, as release of such information is required for the public/third-party businesses to be able to ascertain if they are purchasing from a lawful regulated breeder. It is absurd on it's face to claim that information about a licensed business is information about someone's private life. The fact that a licensed business may or may not be located at a residential address in no way alters the reality that it is a license business premises.

Additionally there is a public interest test with regard to the first principle which is also met. If the public are to be able to assess which breeders are licensed or unlicensed it is imperative that councils be willing to disclose the details of businesses holding a license. The Government say that a purchaser should see a puppy's mother before making a purchase, if the details of licensed breeders are not disclosed to the public (a significant time before any point-of-sale) this is made impossible. Hence licensed breeders details must be supplied to the public on policy grounds and therefore disclosure of such information to a member of the public meets the public interest test.

Without prejudice to the forgoing position that all data regarding breeders/agents must be disclosed, it is further noted that regardless of the status of addresses of business premises, there is most certainly no justification for withholding information such as the name of the breeder/agent and the local authority/area the breeder/agent is located. This is business information regarding a licensed business and cannot be viewed in any other way.
