Thank you for your request for information which was received by the
Council on 1 February 2021. The matter has been dealt with under the
Environmental Information Regulations 2004.
Please find attached the information and presentations provided to
Stakeholders at the Stakeholder panel meeting on Monday 25 January 2021.
(8 attachments in total).
The Council considers some of the information which has been redacted to
be commercially sensitive and confidential therefore, exempt under the
Environmental Information Regulation 2004, 12(5)(f). This
information relates to land values and possible development options for
land in third party ownership which partners provided in confidence to
inform the overall masterplan options.
In terms of the public interest test, there is a public interest in
protecting the commercial interests of third parties and ensuring they are
able to compete fairly. The Council has a duty to protect the interests
of the public by its ability to negotiate the best terms possible with
third parties and protect the public purse, therefore, the public interest
in maintaining the exemption outweighs the public interest in releasing
the information.
Under the Re-Use of Public Sector Information Regulations 2015, you are
free to use any of the information that you have been provided with by the
Council in response to this request. The information may be re-used
subject to the terms of the [1]Open Government Licence.
If you consider that the Council has failed to comply with a requirement
of the Environmental Information Regulations 2004, you may make
representations in writing to the Council within forty working days of
receiving this letter under Regulation 11 of the 2004 Regulations. Such
representations should be addressed to the Chief Executive, Staffordshire
Moorlands District Council, Moorlands House, Stockwell Street, Leek,
Staffordshire Moorlands, ST13 6HQ. The Council will consider your
representations and any supporting evidence which you may produce and
notify you of the Council’s decision within forty working days of the date
that the Council received your written representations.
