Information on the UNICEF launchpad program .

Dear Children and Young People's Commissioner Scotland,

Under the Freedom of Information (Scotland) Act 2002. I would like you to supply me with the following information please .

I've recently learned that Scottish schools will take part in a "UNICEF launchpad" program . Which will teach kids about their rights under the UNCRC and goes on to mention wellbeing and the shannarri indicators . (Recently ruled unlawful by supreme court)

The job of the children's Commissioner is to protect children's rights (amongst other things).

1. Has the Commissioner carried out any review of this program before promoting it on their twitter feed ?

2 . If the Commissioner hasn't looked into a scheme they are promoting . I'd like to know why not ? Given they are tasked with protecting kids rights , which includes privacy.

3 . What options are open to children to refuse or opt out of the data gathering exersize ?

4 . Will parents of young children be informed about this scheme and be asked for their consent for their minor children to be signed up for a website that tracks their use and collects their replies ? If not, then why not ?

5 . Has the Commissioner carried out any review to make sure this is complaint with not only the DPA but also Article 8 given the recent Supreme court judgement re data gathering and sharing without consent ?

Dear Gillian Munro,

Thank you for what are Interesting answers . Whats specially interesting is that it would appear the children's commissioner has forgotten about the children scotland act 1995 and the section setting out parents and kids rights. But the kids rights are not the priority are they ?

What also interesting is that both the commissioner and UNICEF seem to have forgotten that children have a right for their opinions to be heard and taken seriously (UNCRC Article 12) . It's very ironic that in the process of teaching kids about their rights the kids are having their rights breached aswell . Oh the Irony !

In the 1st reply from the commissioner it was stated that they would contact the ICO for clarification on the DPA but in the 2nd im linked to them personally . So did the Commissioner contact the ICO or not ? or do i need to make another FOIA request for this info ?

I have passed your concerns regarding children’s rights and where these may be being breached to the Commissioner.

In response to your question, the Commissioner has not yet contacted the Information Commissioner’s Office (ICO). As stated under item 5.3 in our FOI Review Response, the Commissioner will be writing to the ICO, taking into account the response we received from Unicef UK on 19 October 2016, to seek the ICO’s advice on the extent to which they would consider the Launchpad to be compliant with the Data Protection Act 1998. Once this letter has been sent to the ICO, I will send you a copy.

Ahh ok . So despite a promise from the commissioner to contact they ICO for clarification they havent done so yet but do plan to in future ? How long does it take the commissioner to write a letter or does he have to wait for UNICEF to give him the ability / authority to do this ?

The Commissioner must review law, policy and practice relating to the rights of children and young people with a view to assessing their adequacy and effectiveness. Why didnt the commissioner do this with the launchpad ?

The commissioners job is to promote and safeguard the rights of children. These duties are written in statute. The Commissioner for Children and Young People (Scotland) Act 2003 states clearly

"(1)The general function of the Commissioner is to promote and safeguard the rights of children and young people.

(2)In exercising that general function the Commissioner is, in particular, to—

(a)promote awareness and understanding of the rights of children and young people;

(b)keep under review the law, policy and practice relating to the rights of children and young people with a view to assessing the adequacy and effectiveness of such law, policy and practice;"

Why hasnt the commissioner done any of this ?

In light of the recent supreme court decision (Re: collecting and sharing kids data without consent being ruled unlawful) why hasnt the commissioner halted this program until a review on its compatibility with this judgement has been carried out ? Being a data controller does NOT mean they can act in contempt of the UK Supreme Court .
