Request for information under the Freedom of Information Act 2000 (FOIA) /
Environmental Information Regulations 2004 (EIR)

 

Thank you for your request for information for any and all electronic,
written, transcribed, or other, information regarding the granting of
permit EPR/WP3234DY to Covanta Energy Limited received on 26 January 2018.

 

We respond to requests for information that we hold under the Freedom of
Information Act 2000 (FoIA) and the associated Environmental Information
Regulations 2004 (EIR).

 

We want to be as open as possible in answering requests, and to help
people obtain the information they are looking for. Unfortunately, in this
case the amount of information you have requested is very substantial.
Gathering it together would therefore be likely to involve a significant
cost and diversion of resources from our other work.

 

In these situations the legislation allows us to consider refusing
requests as ‘manifestly unreasonable’ under EIR and/or ‘above the
appropriate limit’ under FOIA.

 

We estimate that it would take approximately 290 hours to comply with your
request in its current form. This is based on staff time locating,
retrieving, editing and copying data from e.g. paper files/electronic
records in a number of databases. 

 

In order to help us bring your request within reasonable bounds, I have
attached a copy of our Decision Document for the Covanta Energy Limited
permit determination. After reading this document, would you be able to
reduce the scope of your request to focus on the precise information that
you are seeking?

 

If you are unable or unwilling to narrow down your request we will, of
course, consider it in accordance with our obligations under FOI and EIR.
However we wanted to give you an opportunity to reconsider your request
and describe more precisely the information you wish to have.

Dear Area Manager Correspondence, East Anglia,

Thank you for your response. To answer your question, the areas I am specifically requesting are:

1) Contact between the EA and Covanta regarding the procedures to be put in place to mitigate the effects of any potential discharge over and above agreed limits.
2) Contact between the EA and Covanta regarding the need to import waste from outside the local area to meet the requirements of the proposed incinerator.
3) Contact between the EA and Covanta regarding the impact on local wildlife of the proposed incinerator.
4) Contact between the EA and Covanta regarding the Marston Vale Forest Centre.
5) A list of all hospitality provided to EA staff by Covanta or any of its suppliers or subsidiaries during the review and consultation periods prior to and during the decision making process.

I am prepared to separate these in to five separate requests should it be deemed that servicing them in one package would be too onerous - if that is the case then please advise me of this and I will split the requests up.
