Dear Ms Gray,

Thank you for your freedom of information request dated 16 September,
2020:-

Could you furnish me with information on your transgender policies for
people participating in sport. Specifically:

o Advice given and by whom (individuals or organisations) as to the
content of transgender policies
o Any and all consultations on the above mentioned policies;
o Any and all Equality Impact Assessments/risk assessment  done before
drawing up said policy and after the policies were enacted

Equalities and inclusion as a whole is at the forefront of sportscotland’s
corporate strategy and embedded throughout the business areas. Scottish
Governing Bodies of Sport have accountability for their own individual
policies and the implementation of these, and receive independent support
to assist with the creation of these policies.

Therefore, sportscotland does not have a specific transgender policy for
people participating in sport.  We do not hold the requested information
(section 17 of the Freedom of Information (Scotland) Act 2002 (notice that
information is not held)).

sportscotland did however produce a learning note on gender reassignment
in 2016 as part of the Equality and Sport research, that may be of

no consultation or equality impact assessment.

Finally, the current transgender guidance (link below), Transgender People
and Competitive Sport, was developed in September, 2013 by the Sports
Council Equality Group.  As sportscotland did not lead on this work, we do
not hold any information on consultation or equality impact assessments.
Please note that there is currently a project underway to review this
guidance.
