Information on 5G infrastructure, insurance and compliance

Dear North Yorkshire County Council,

My name is Carolyn Ryan, my contact details are to respond via Whatdotheyknow. Please let me know promptly if this is not sufficient under FOI law and do not simply ignore my request again.

Under the Freedom of Information Act 2000, can you supply full information
on the following:

1) Location of all 5G towers, of monopole or other design in the North of
the former Craven District Council area (including Settle, Austwick,
Eldroth, Ingleton, Long Preston and surrounding countryside etc) plus any
other 5G equipment.

Please provide copies of the environmental and health impact analysis for
each of the installations?

2) Provide liability and other insurance details that the Council hold for
radiation exposures and harm against the person that the Council have or
received from the installation companies.

3) Provide the structural integrity data report for the monopolies etc and
product insurance for structural integrity, fire and fatigue collapse.

4) Provide details of your certification (or the self-certification
certificate from the

installers) with ICNIRP guideline showing actual radiation output levels from
each radiation transmitter in watts/micro watts to confirm compliance. Please also
provide details of regular checks made to ensure continued compliance,
both the procedures and the results of all checks since installation.

5) Provide details of the Councils compliance with the Social Care Act

2012 in regard protection from increasing Ionizing and Non Ionizing
emissions from 5G installations I would appreciate your immediate
attention, as the safety is imperative and paramount.

Please see below the response to your Freedom of information request.

 

1 The County Council are unaware of any 5G installations in the areas that
you have indicated.

 

2 We provide copies of the relevant insurance documents and policies
hereto –“ we can confirm that NYCC are insured for public liability risks
and this cover includes an element of protection for pollution risks.  Any
area not covered by the policy is because the Council have (1) made a
conscious decision not to insure as part of its overall risk financing
strategy of operating the public purse prudently, as it does with many
risks (2) the cover is not available at commercially acceptable terms or
(3) the cover is not available in the market.”

 

3 The structural integrity of any installation is the responsibility of
the company providing these infrastructures.  

 

4 The installers provide information to the local planning authority as
part of their submitted plans stating that they work within the ICNIRP
guidance on all installations.

 

5 UK Health Security Agency (UKHSA) formally Public Health England, Centre
for Radiation, Chemical and Environmental Hazards (CRCE) takes the lead on
public health matters within radiofrequency electromagnetic fields, or
radio waves, used in telecommunications. Central to UKHSA advice is that
exposures to radio waves should comply with the ICNIRP guidelines. The
council follow and rely on these guidelines as they are the recognised
experts in this field.

Could you please clarify why you did not categorically state that there are no 5G towers/equipment in the specified area, but only that NYCC is unaware of any? How might such large and potentially dangerous equipment be placed without the Council's permission?

It is not NYCC’s responsibility to grant or deny permission of 5G
infrastructure, it is the responsibility of the district council planning
department. However NYCC officers monitor the applications of such
infrastructure and are unaware of any being made in the specified area.

Dear Bes Contactus,
Re your response to my request for clarification. Is Craven District Council still in operation? I heard it was being dissolved and that there is now a unitary authority.
Other foi enquiries (from other people) to NYCC about 5G infrastructure through whatdotheyknow have been answered without the questioner being informed that its the DC's who are responsible.

Craven District Council ceases to exist on 31st March 2023. Following this it is North Yorkshire Council as a unitary authority who will have the responsibility for all 5G infrastructure going forward.
