Dear Hertfordshire County Council,
May I once again ask you for any information that you hold or have in any form on the above audit that your staff carried out

You have informed me in a previous reply that you are unable to say if the information contained in the above audit is correct or incorrect

I have an e-mail from the manager carrying out the audit and here I quote hes exact words dated 3 10.2012 Gursh Bains Hertfordshire CC

Dear Tom
We are treating this audit work as a priority and the audit field work is almost complete ,it then needs to through our quality review process which may mean the auditor has to go back and do further testing .It is difficult for me to give you a date of when this report will be available to you ,as you will appreciate I need to be fully satisfied with the factual accuracy of the work before the report can be issued You are welcome to request a status update of the progress in completing the audit at any time

Now you have sent me a reply through an FOI request informing me that you do not know if the audit is correct or not and you have also informed me that I have no right to query this audit you have prevented me from asking questions at full council on this audit you inform me that my issues are with Hertsmere but Gursh Bains was an employee of Heretfordshire and he tells me he will be making the report available to me He in fact sent it to my home

Plese let me have all the information that you hold on this audit

In accordance with the Freedom of Information Act 2000 (FOIA) this
correspondence is a Refusal Notice. The information requested is refused
for the reasons set out below:

 

Under Section 14(1) of the Act, you were informed in correspondence
addressed to you on 19th December 2013 that Hertfordshire County Council
considered your requests in relation to audit M 4110/12/003 to be
vexatious and as a consequence we refused to process any further requests
we received from you in relation to this subject. In line with this
correspondence the Council is not obliged to comply with a request for
information if it is deemed that the request is vexatious.

 

Under Section 14(2) of the Act, the Council does not have to comply with a
subsequent request which is identical or substantially similar, from that
person unless a reasonable time has elapsed between compliance with the
previous request and the making of the current request. In this case you
have requested this information on previous occasion and had information
supplied to you.  

 

I consider this matter closed and I am not intending to enter into further
correspondence with you on this topic.

 

As an internal review was carried out in relation to the original refusal
notice under Section 14 of the Act, we are not in a position to offer you
a chance of an internal review and would suggest that if dissatisfied that
you request that the Information Commissioner investigate your complaint.
