Dear Wirral Metropolitan Borough Council,
Could you kindly provide me with information held by your Information Communications &Technology Department on the number of electronic messages forwarded from a Wirral Council email account to personal or other email accounts in a lower classification domain (eg, an internet email account such as hotmail) by Wirral Council Officers, Elected Members, and Independent Advisers in 2017.
Mr Leyland Otter
Dear Mr Otter
Thank you for your recent Freedom of Information request in which you asked for the following information:
"...the number of electronic messages forwarded from a Wirral Council email account to personal or other email accounts in a lower classification domain (e.g., an internet email account such as hotmail) by Wirral Council Officers, Elected Members, and Independent Advisers in 2017."
Wirral Council does endeavour, where possible, to provide responses to such enquiries within the specified timescale. However, having liaised with our Digital Department regarding the scope of your request, we must advise that your enquiry falls under the exemption set out at Section 12 of the Freedom of Information Act 2000.
Under Section 12 of the Freedom of Information Act 2000, public authorities are not required to comply with a request for information if it is estimated that to do so would exceed the appropriate limit, currently set at 18.5 hours. It is the Council's position that to facilitate your enquiry would exceed this limit and as such the Council relies on section 12 (1) to refuse your request.
You may wish to consider reducing the scope of your request, i.e. limiting to a singular specific email provider over a shorter timescale and we will endeavour to provide the information if possible within the legislative provisions.
You have the right under Section 17 of the Freedom of Information Act 2000 to ask for an internal review of the refusal of the information requested. Please direct any request for an internal review to [Wirral Borough Council request email] and your request will be allocated to another officer for review.
If you are dissatisfied with the outcome of an internal review you also have the right to complain to the information Commissioner, who can be contacted at https://ico.org.uk/global/contact-us/
