Information concerning the Severe Weather Emergency Protocol

Dear Wrexham County Borough Council,

Following my recent request (FOI 7724) for a copy of WCBC’s Severe Weather Emergency Protocol (SWEP) I am writing to you under the freedom of information act 2000 to request the following information.

1. The copy of the SWEP policy provided wasn’t dated. Could you tell me what date this policy was written? Could you also tell me what date the policy came into force?

2. The SWEP policy provided appears to be part of a document titled ‘Homelessness’, could you email me a copy of the whole document please?

3. Does WCBC have a legal obligation to implement all the points outlined in the policy, or are they guidelines?

4. How much money has WCBC spent on implementing SWEP? And how much money has WCBC received from the Welsh Government to reimburse the cost of SWEP?

5. What time of day does WCBC receive the MET office weather report? If the weather report indicates the implementation of SWEP, what time of day (or how soon after the weather report) are the partner agencies informed and, what time of day do you expect known service users to be informed?

6. Is SWEP implemented only when the temperature is sub-zero, or is it also implemented when the temperature is above zero but considered sub-zero due to the wind chill factor?

7. How do the Housing Options Team and their partners relay that SWEP is in force to known service users?

8. Is there more detailed information held by the council concerning SWEP? If there is, please could you provide me with a copy of this information?

9. Since the implementation of the SWEP policy how many rough sleepers have contacted the Housing Options Team during office hours? How many of those that have made contact have been provided with B&B accommodation?

10. Where are rough sleepers that are under the influence of drink/drugs given shelter during SWEP?

11. How do rough sleepers contact the Housing Options Team at the weekend if they wish to access B&B accommodation? What are the Housing Options Team’s office hours?

If it is not possible to provide the information requested due to the information exceeding the cost of compliance limits identified in Section 12, please provide advice and assistance, under the Section 16 obligations of the Act, as to how I can refine my request.

I am writing to request an internal review of Wrexham County Borough Council's handling of my FOI request 'Information concerning the Severe Weather Emergency Protocol'.

There were a number of questions I felt weren’t answered fully, and others that weren’t answered at all.

Question 2. I asked:
The SWEP policy provided appears to be part of a document titled ‘Homelessness’, could you email me a copy of the whole document please?

Your response was:
There is no document entitled “Homelessness” but if you would like more information then please find the following link to the Council’s website which deals with homelessness: http://www.wrexham.gov.uk/english/counci...

I felt this response was inadequate and evasive. I felt it was obvious I was asking for a copy of the document of which the SWEP policy is a part. The document in question is titled ‘Homelessness’ on the copy you provided to me in response to FOI 7724, but it starts at procedure 9.11. Could you please provide me with the full document in which the SWEP policy is contained? I accept that the document has another title.

Question 3. I asked:
Does WCBC have a legal obligation to implement all the points outlined in the policy, or are they guidelines?

Your response was:
It is mandatory for all local authorities to have a SWEP in place.

I don’t believe this is an answer to the question I asked. I was already aware that it was mandatory for local authorities to have a SWEP policy. My question was whether it therefore followed that WCBC then had a legal obligation to ensure the procedures outlined in the policy were carried out.

Question 4. I asked:
How much money has WCBC spent on implementing SWEP? And how much money has WCBC received from the Welsh Government to reimburse the cost of SWEP?

Your response was:
This information is not available.

Could you please provide me with more details concerning this matter? Why is this information not available? Is this information available elsewhere? Is this information not available to the public, and if so, why not? No explanation or clarification has been offered. I find it difficult to believe WCBC doesn’t know how much money it receives from the Welsh Government for SWEP, it surely should.

Question 5. I asked:
What time of day does WCBC receive the MET office weather report? If the weather report indicates the implementation of SWEP, what time of day (or how soon after the weather report) are the partner agencies informed and, what time of day do you expect known service users to be informed?

Your response was:
Unable to advise what time WCBC receives the MET office weather report as this information does not go directly to Housing Options. Partner agencies are notified immediately the protocol is triggered and known service users are informed directly.

I felt more details and clarification could’ve been made regarding this question. Could you provide information regarding which department does receive the MET office weather report, what time they receive it, and how quickly that information is relayed to the Housing Options Team and partner agencies?

Question 7. I asked:
How do the Housing Options Team and their partners relay that SWEP is in force to known service users?

Your response was:
Partner agencies notify service users via the outreach workers

This question has clearly not been answered. I didn’t ask who informed the service users, I asked how they were informed. No explanation has been given as to how the outreach workers make contact with service users. By service users I mean anybody entitled to access services under SWEP, including those that don’t actively approach Ty Nos or other partner agencies directly themselves. Do the outreach workers actively patrol the streets looking for rough sleepers, for example?

Question 9. I asked:
Since the implementation of the SWEP policy how many rough sleepers have contacted the Housing Options Team during office hours? How many of those that have made contact have been provided with B&B accommodation?

Your response was:
This information is not collected

Obviously this raises Further questions. If this information is not collected, how does WCBC keep a record of the implementation costs of SWEP? How does the Welsh Government reimburse WCBC if there are no detailed records of where the money has been spent? There is no explanation why this information is not collected.

Question 10. I asked:
Where are rough sleepers that are under the influence of drink/drugs given shelter during SWEP?

Your response was:
Any rough sleeper can access the service.

Again, this is clearly not an answer to the question I asked. With reports of rough sleepers not being allowed to stay in Ty Nos during SWEP because they are under the influence of drink/drugs, or for other reasons such as being banned, where are these people offered accommodation?

Question 11. I asked:
How do rough sleepers contact the Housing Options Team at the weekend if they wish to access B&B accommodation? What are the Housing Options Team’s office hours?

Your response was:
Contact can be made through the out of hours service. The office hours are 9.00 – 4.30 Monday, Tuesday, Wednesday & Friday and Thursday 10.00 – 5.30 pm.

I felt this response required more detail. If rough sleepers contact the out of hours service, are the out of hours service able to allocate B&B accommodation. If so, does this happen?

In essence, what I am trying to ascertain is the following.

1. Does WCBC give rough sleepers adequate time from when the SWEP protocol is triggered for them to contact the Housing Options Team during office hours in order to secure B&B accommodation as outlined in your SWEP policy?

2. If not, are rough sleepers able to receive the same level of service and access B&B accommodation from the out of hours service?

3. Have any rough sleepers been given B&B accommodation under SWEP?

4. Is the SWEP policy robust enough for WCBC and their partners to ensure every effort is being made to contact rough sleepers, even those not actively engaged in services, to ensure they are aware SWEP has been triggered and there are services available to suit their individual needs?

5. Does WCBC have a legal obligation to carry out the protocol outlined in the SWEP policy, or is it only mandatory to have a SWEP policy whereby the procedures outlined are merely guidelines?

6. I would like to have a better understanding of how WCBC keeps a record of the costs incurred from the implementation of SWEP. How WCBC keeps track of the number of people that have sought help, and the numbers that have received help. I would also like to know how the Welsh Government makes payments to WCBC for SWEP if no records on this information are held. For example, does the Welsh Government pay out a lump sum for which no accounts are required? I find it astonishing that the council don’t have these figures unless the number of people accessing B&B accommodation is zero. If this is the case, can WCBC confirm that no rough sleepers have been provided with B&B accommodation under SWEP? I would like much more clarification and information concerning the finances of SWEP, at present I can’t see who is keeping account of the figures, let alone what those figures are.

Overall I am disappointed with the responses I have received; very little information has been given. Not only have they not helped me get a better understanding of the issues I’ve raised above, but some of the responses seem to me to be evasive, and some have clearly not answered my question at all; and where no information is held, no further explanation is given.

Any rough sleeper can access the service.

 

Again, this is clearly not an answer to the question I asked. With reports
of rough sleepers not being allowed to stay in Ty Nos during SWEP because
they are under the influence of drink/drugs, or for other reasons such as
being banned, where are these people offered accommodation?

 

Question 11. I asked:

How do rough sleepers contact the Housing Options Team at the weekend if
they wish to access B&B accommodation? What are the Housing Options Team’s
office hours?

 

Your response was:

Contact can be made through the out of hours service. The office hours are
9.00 – 4.30 Monday, Tuesday, Wednesday & Friday and Thursday 10.00 – 5.30
pm.

 

I felt this response required more detail. If rough sleepers contact the
out of hours service, are the out of hours service able to allocate B&B
accommodation. If so, does this happen?

 

In essence, what I am trying to ascertain is the following.

 

1.         Does WCBC give rough sleepers adequate time from when the SWEP
protocol is triggered for them to contact the Housing Options Team during
office hours in order to secure B&B accommodation as outlined in your SWEP
policy?

 

2.         If not, are rough sleepers able to receive the same level of
service and access B&B accommodation from the out of hours service?

 

3.         Have any rough sleepers been given B&B accommodation under
SWEP?

 

4.         Is the SWEP policy robust enough for WCBC and their partners to
ensure every effort is being made to contact rough sleepers, even those
not actively engaged in services, to ensure they are aware SWEP has been
triggered and there are services available to suit their individual needs?

 

5.         Does WCBC have a legal obligation to carry out the protocol
outlined in the SWEP policy, or is it only mandatory to have a SWEP policy
whereby the procedures outlined are merely guidelines?

 

6.         I would like to have a better understanding of how WCBC keeps a
record of the costs incurred from the implementation of SWEP. How WCBC
keeps track of the number of people that have sought help, and the numbers
that have received help. I would also like to know how the Welsh
Government makes payments to WCBC for SWEP if no records on this
information are held. For example, does the Welsh Government pay out a
lump sum for which no accounts are required? I find it astonishing that
the council don’t have these figures unless the number of people accessing
B&B accommodation is zero. If this is the case, can WCBC confirm that no
rough sleepers have been provided with B&B accommodation under SWEP? I
would like much more clarification and information concerning the finances
of SWEP, at present I can’t see who is keeping account of the figures, let
alone what those figures are.

 

Overall I am disappointed with the responses I have received; very little
information has been given. Not only have they not helped me get a better
understanding of the issues I’ve raised above, but some of the responses
seem to me to be evasive, and some have clearly not answered my question
at all; and where no information is held, no further explanation is given.

With reference to your recent Review of your previous request (FOI 7795),
this is an acknowledgement that Wrexham County Borough Council have
received further correspondence.  Under the FOIA, we have 20 working days

The additional information required:

 

1.    How much money has WCBC spent on implementing SWEP? And how much
money has WCBC received from the Welsh Government to reimburse the cost of
SWEP?

3.    I would like to have a better understanding of how WCBC keeps a

cost of disbursements, including photocopying and postage, and a list of
