As stated in my last email, our understanding is that you were provided
with everything that you requested. If you were not, you will need to
explain to us what additional information you require. We asked you to
clarify what information is still outstanding; it is not helpful to simply
ask for “the remainder of the material requested in the original email”.

 

You say: “I need information concerning all instances on single use
booking”. I’m sorry, but it is not clear to us what you mean by that. Do
you mean you want to see details of all of the bookings for a particular
facility? If so, which facility and for what time period? You should note
that personal information is exempt from the Freedom of Information Act so
we will not be able to provide you with information about individuals.

 

The Freedom of Information Act entitles people to access recorded
information. This would include copies of original documents. However, it
does not entitle people to information such as dates of “composition of
documents”.

 

I have attached a copy of your original email requests, which, as you can
see, did not request paper copies. If you’d like us to post a paper copy
of the original response, please give us your postal address.

 

We would like to ensure that we provide you with all of the information to
which you are entitled and will do so when you clarify what information

provided in the response to you.

 

Therefore – your request for an internal review is as follows:

 

- you did not receive  a list of all the exclusive use arrangements in the
Borough

- the response was overdue

 

Please confirm if I have understood your complaint correctly - and if you
wish to add to the complaint. 

 

We would like to ensure that we have provide you with all of the
information to which you are entitled and will do so when you clarify what
information you want.

 

 

2.         It seems that you are now requesting the booking forms and
conditions - in addition to a list of all the exclusive use arrangements.
As this was not part of your original request, we would need to log this
as a new FOI request. Please confirm if you wish this to be logged as a
new FOI request and please clarify the time period in which you are
interested.

 

3.         Regarding your request for confirmation that we have examined

Firstly: We have no reason to believe that the service have fabricated
documents in order to respond to you.  

 

Secondly: Please note that we are not under any obligation to personally
check when the documents were originally created. Please note that, the
Freedom of Information Act gives you the right to access information that
is held on record by public authorities. The Act does not give people a
right to be given answers to questions that they would like to put to a
local authority.

 

4.         If you'd like us to post a paper copy of the original response,

This is al very Baby P!

The requests are far out of date, and you are now creating confusion about the actual requests, which have been made clearly, properly and in writing.

The fact that your Data Protection Team deleted correspondence without opening it is neither here nor there!

I am aware of several such cases where Haringey has just gone back to people concerned about your handling of their personal date, to ask for the correspondence to be sent again, as it was deleted by the Data Protection Team!

Various officers have recently been furiously deleting the correspondence about these matters, and a senior officer has indicated that he and his officers will not reply to them, as it takes too much time!

All the Haringey processes have been late or indeed failed altogether, which I will detail in another posting/

To be clear - You have failed to indicate that that the documents were created at the time indicated, which is the simplest of matters. If all was in order, you would simply have stated that.

Nor have I received the copies of the original documents by post which you said had been sent. They should not be PDF's - I want both sides and a copy of the metadata for each document. I also want a print screen listing of the There is no reason that you should fail to provide this information, if Haringey has not been guilty of manufacturing documents, at a late stage in a complaints process to justify its actions.

I am not asking you to take those materials into safe keeping to prevent alteration or destruction of the evidence.

I am responding to both this e-mail and the e-mail you sent on 31 July at
00:30.

 

Request for an Internal Review

My Colleague Ms Pietikainen had advised you in her e-mail to you dated 28
July of the confirmation we need in order to progress an Internal Review
of the response you have received to Freedom of Information (FOI) request
reference 810001393.

 

Although you have sent us two extensive e-mails you have not clearly
answered the queries raised by Ms Pietikainen which would enable us to
progress your issues.  Until we receive this we are unable to process the
Internal Review for you.  

 

I'm aware you are of the view that the service has fabricated the
documents you have been sent but this is not a matter we could pursue as
an Internal Review.  The purpose of an Internal Review is to review the
decision to either provide the information or any exemptions which may
have been applied.  In this case we have provided the recorded information
held (with the exception of the list of all the exclusive use arrangements
in the Borough). 

 

Further information requested

Regarding the information you are now requesting, I note this to be as
follows:

   

A. A copy of the 'metadata' for each document you have been provided with
in the request 810001393.

Please clarify what you mean by metadata.

 

B. You also say you want a print screen listing of the...

Please confirm what you require a screen print of.

 

C. Ms Pietikainen asked if you were requesting the booking forms and
conditions - in addition to a list of all the exclusive use arrangements,
and explained that as this was not part of your original request, we would
need to log this as a new FOI request. You have not confirmed if this is
the case and the time period you are interested in.

 

We will take no further action on this until you clarify these points
clearly.

 

 

You have asked that we take the materials into safe keeping to prevent
alteration or destruction of the evidence.  This is outside of our Freedom
of Information procedures and I reiterate that we have no reason to
suspect the service has manipulated documents purely to respond to your
request.  We have a record of the information which was provided to you
which is adequate for our purposes.

 

You have asked to be posted copies of the documents already released to
you and say that we have your postal address.  I have checked our records
and cannot find a postal address listed for you.  If you provide your
address we will send you copies of the documents in the post.
